margin-bottom: 0\" align=\"justify\">por el cual se \u00a0establecen las escalas de remuneraci\u00f3n de los empleos de los Ministerios, \u00a0Departamentos Administrativos, Superintendencias, Establecimientos P\u00fablicos y \u00a0Unidades Administrativas Especiales del orden nacional y se dictan otras \u00a0disposiciones. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 1\u00b0 El presente Decreto \u00a0fija las escalas de remuneraci\u00f3n de los empleos correspondientes a los Ministerios, \u00a0Departamentos Administrativos, Superintendencias, Establecimientos P\u00fablicos y \u00a0Unidades Administrativas Especiales del orden nacional. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Articulo 2\u00b0 A partir del 1\u00b0 de \u00a0enero d\u00e9 1984, establ\u00e9cense las siguientes escalas de remuneraci\u00f3n mensual para \u00a0los empleos regulados por los Decretos extraordinarios 712, 1042 de 1978 y \u00a0dem\u00e1s normas que los modifiquen o adicionen: \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; La tercera columna fija los \u00a0gastos de representaci\u00f3n para cada grado y la cuarta columna, el total de la \u00a0remuneraci\u00f3n por asignaci\u00f3n b\u00e1sica m\u00e1s gastos de representaci\u00f3n. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Para los niveles Ejecutivo, \u00a0Profesional, T\u00e9cnico, Administrativo y Operativo, la primera columna fija los \u00a0grados de remuneraci\u00f3n que corresponden a las distintas denominaciones de \u00a0empleos y la segunda columna comprende las asignaciones b\u00e1sicas para cada \u00a0grado. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 4\u00b0 Las asignaciones \u00a0fijadas en las escalas se\u00f1aladas en este Decreto, corresponden exclusivamente a \u00a0empleos de car\u00e1cter permanente y de tiempo completo. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Por ning\u00fan motivo se crear\u00e1n \u00a0empleos cuya jornada de trabajo sea diferente a tiempo completo o medio tiempo. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Para los efectos de este Decreto \u00a0se entiende por empleos de medio tiempo los que tiene jornada diaria de cuatro \u00a0(4) horas. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Los empleos de medio tiempo se \u00a0remunerar\u00e1n en forma proporcional al tiempo trabajado. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 5\u00b0 No obstante lo \u00a0dispuesto en el art\u00edculo anterior, los empleos por hora\/mes d\u00e9 m\u00e9dico y \u00a0odont\u00f3logo, se remunerar\u00e1n en forma proporcional a la asignaci\u00f3n b\u00e1sica que les \u00a0corresponda de acuerdo con el n\u00famero de horas. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 6\u00b0 A partir del 1\u00b0 de \u00a0enero de 1984, la remuneraci\u00f3n mensual del empleo de Superintendente Delegado \u00a0Grado 16, del nivel Ejecutivo, ser\u00e1 equivalente al ochenta por ciento (80%) de la \u00a0remuneraci\u00f3n mensual que por concepto de asignaci\u00f3n b\u00e1sica y gastos de \u00a0representaci\u00f3n corresponda al cargo de Superintendente Grado 04 del nivel \u00a0Directivo. El cincuenta por ciento (50%) de esta remuneraci\u00f3n mensual, tendr\u00e1 \u00a0el car\u00e1cter de gastos de representaci\u00f3n. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 7\u00b0 El reajuste de la \u00a0remuneraci\u00f3n de los empleos a que se refieren los art\u00edculos 5\u00b0 y 6\u00b0 del Decreto ley 8693 \u00a0de 1981 y los Decretos-leyes 250 de 1982; \u00a0103, 292, 293 de 1983, se pagar\u00e1 con base en las nuevas escalas fijadas en el \u00a0presente Decreto y en la proporci\u00f3n de asignaci\u00f3n b\u00e1sica y gastos de \u00a0representaci\u00f3n, que dichos Decretos se\u00f1alan. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Las entidades a que se refiere \u00a0el presente art\u00edculo, fijar\u00e1n el valor de los vi\u00e1ticos seg\u00fan la remuneraci\u00f3n mensual \u00a0del funcionario comisionado, la naturaleza de los asuntos que le sean confiados \u00a0y el lugar donde deba llevarse a cabo la labor hasta por las cantidades \u00a0se\u00f1aladas en el presente art\u00edculo. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Pata determinar el valor de \u00a0los vi\u00e1ticos, se tendr\u00e1 en cuenta la asignaci\u00f3n b\u00e1sica, los gastos de \u00a0representaci\u00f3n y los incrementos de salario por antig\u00fcedad. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Dentro del territorio nacional \u00a0s\u00f3lo se reconocer\u00e1n vi\u00e1ticos cuando el comisionado deba permanecer por lo menos \u00a0un d\u00eda completo en el lugar de la comisi\u00f3n, fuera de su sede habitual de \u00a0trabajo. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Cuando para el cumplimiento de \u00a0las tareas asignadas no se requiera pernoctar en el lugar de la comisi\u00f3n, solo \u00a0se reconocer\u00e1 el cincuenta por ciento (50%) del valor fijado. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo10. A partir del 1\u00b0 d\u00e9 \u00a0enero de 1984, reaj\u00fastase en un dieciocho punto cinco por ciento (18.5%) el \u00a0incremento de salario por antig\u00fcedad que ven\u00edan percibiendo algunos \u00a0funcionarios en virtud de lo dispuesto en los Decretos extraordinarios 1042 de 1978, 305 de 1981 y 69 de 1083. Si al \u00a0aplicar el porcentaje de que trata el presente art\u00edculo, resultaren centavos, \u00a0se desechar\u00e1n. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 11. El Subsidio de Alimentaci\u00f3n \u00a0de los empleados p\u00fablicos de las entidades a que se refiere el art\u00edculo 1\u00b0 del \u00a0presente Decreto que devenguen asignaciones b\u00e1sicas mensuales no superiores a \u00a0treinta y cuatro mil seiscientos cincuenta pesos ($ 34.650.00), ser\u00e1 de un mil \u00a0ciento veinticinco pesos ($ 1.125.00) mensuales, moneda corriente, pagaderos \u00a0por las respectivas entidades \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">No se tendr\u00e1 derecho a este \u00a0Subsidio cuando el funcionario disfrute de vacaciones o se encuentre en uso de \u00a0licencia. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Par\u00e1grafo. Cuando las \u00a0entidades suministren alimentaci\u00f3n a los empleados que conforme a este art\u00edculo \u00a0tengan derecho al Subsidio, no habr\u00e1 lugar a su reconocimiento en dinero \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 12. Modificado por el Decreto 415 de 1984, \u00a0art\u00edculo 1\u00ba. Los empleados subalternos del Ministerio de Hacienda y Cr\u00e9dito \u00a0P\u00fablico que tengan la obligaci\u00f3n de participar en trabajos ordenados para la \u00a0preparaci\u00f3n y elaboraci\u00f3n del presupuesto de rentas y ley de apropiaciones, su \u00a0liquidaci\u00f3n y dem\u00e1s labores anexas al cierre e iniciaci\u00f3n de cada vigencia \u00a0fiscal, podr\u00e1n devengar horas extras, dominicales y festivos, siempre y cuando \u00a0est\u00e9n comprendidos en los siguientes niveles: \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">El nivel operativo; el nivel Administrativo hasta el \u00a0grado s 19 inclusive; el nivel T\u00e9cnico hasta el grado 12 inclusive; el nivel \u00a0Profesional hasta el grado 10 inclusive, y el nivel Ejecutivo hasta el grado 09 \u00a0inclusive. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">En ning\u00fan caso podr\u00e1 pagarse mensualmente por el total de \u00a0horas extras, dominicales y festivos, m\u00e1s del 40% de la remuneraci\u00f3n de cada \u00a0funcionario. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Texto inicial del art\u00edculo 12.: \u201cLos empleados subalternos del Ministerio de Hacienda y \u00a0Cr\u00e9dito P\u00fablico que tengan la obligaci\u00f3n de participar en trabajos ordenados \u00a0para la preparaci\u00f3n y elaboraci\u00f3n del presupuesto de rentas y ley de \u00a0apropiaciones, su liquidaci\u00f3n y dem\u00e1s labores anexas al cierre e iniciaci\u00f3n de \u00a0cada vigencia fiscal podr\u00e1n devengar horas extras, dominicales y festivos, siempre \u00a0y cuando est\u00e9n comprendidos en los siguientes niveles: \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">El nivel Operativo; el nivel Administrativo \u00a0hasta el Grado 16 inclusive; el nivel T\u00e9cnico hasta el Grado 10 Inclusive; el \u00a0nivel Profesional hasta el Grado 10 inclusive, y el nivel Ejecutivo hasta el \u00a0Grado 09 inclusive. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">El Director General del Presupuesto podr\u00e1 \u00a0autorizar el trabajo de horas extras, dominicales y festivos, para la \u00a0elaboraci\u00f3n de los trabajos anteriormente citados, sin que la cuant\u00eda mensual \u00a0exceda el 25% de la remuneraci\u00f3n de cada funcionario.\u201d. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo. 13. El presente Decreto \u00a0no se aplicar\u00e1: \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">a) A los empleados p\u00fablicos \u00a0del Ministerio de Relaciones Exteriores que prestan servicio en el exterior. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">b) Al personal docente de los \u00a0distintos organismos de la Rama Ejecutiva que se rigen por normas especiales. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">c) A los empleados p\u00fablicos de \u00a0las entidades que tienen sistemas especiales de remuneraci\u00f3n legalmente \u00a0aprobados. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">d) Al personal de las fuerzas \u00a0Militares y a los empleados civiles del Ministerio de Defensa Nacional que no se \u00a0rigen por el Decreto \u00a0extraordinario 1042 de 1978 y dem\u00e1s normas que lo modifiquen o adicionen. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">e) Al personal de la Polic\u00eda \u00a0Nacional y a los empleados civiles al servicio de la misma. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">f) Al personal de que trata el \u00a0Decreto 115 de 1983. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Par\u00e1grafo. Los decretos que \u00a0fijen el reajuste de las remuneraciones de los funcionarios a que se refieren \u00a0los literales b) y c) del presente art\u00edculo, que tienen sistemas especiales de \u00a0remuneraci\u00f3n legalmente aprobados, no podr\u00e1n exceder del dieciocho punto cinco \u00a0por ciento (18.5%). \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 14. El reajuste de \u00a0las escalas de remuneraci\u00f3n para los empleados p\u00fablicos que prestan sus \u00a0servicios en las empresas industriales y comerciales del Estado y las sociedades \u00a0de econom\u00eda mixta, sometidas al r\u00e9gimen de dichas empresas, se sujetar\u00e1 a lo \u00a0dispuesto en el par\u00e1grafo del art\u00edculo 13 del presente Decreto. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Art\u00edculo 15. El presente Decreto \u00a0rige a, partir de la fecha de su expedici\u00f3n, deroga las disposiciones que le \u00a0sean contrarias y surte efectos fiscales a partir del 1\u00b0 de enero de 1984, \u00a0salvo lo dispuesto en el art\u00edculo 9\u00b0. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Comun\u00edquese y c\u00famplase. \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">\u00a0 \u00a0 \u00a0<\/p>\n<p style=\"margin-top: 0; margin-bottom: 0\" align=\"justify\">Dado en Bogot\u00e1, D.
