DE LA JUNTA \u00a0DIRECTIVA DEL INSTITUTO COLOMBIANO DE LA REFORMA AGRARIA, INCORA, QUE ESTABLECE \u00a0LA PLANTA DE PERSONAL. \u00a0 \u00a0<\/p>\n<p>Nota: Derogado por el Decreto 1092 de 1995, \u00a0art\u00edculo 2\u00ba. \u00a0 \u00a0<\/p>\n<p>El Presidente de la Rep\u00fablica de \u00a0Colombia, en uso de sus atribuciones legales y en especial de las que le confiere \u00a0el inciso 2\u00b0 \u00a0del art\u00edculo 74 del Decreto ley 1042 de 1978,. \u00a0 \u00a0<\/p>\n<p>DECRETA: \u00a0 \u00a0<\/p>\n<p>ARTICULO 1\u00b0 Apru\u00e9base el Acuerdo n\u00famero 05 del 9 de \u00a0febrero de 1993, expedido por la Junta Directiva del Instituto Colombiano de la \u00a0Reforma Agraria, Incora mediante el cual se establece la Planta de Personal, y \u00a0cuyo texto es el siguiente: \u00a0 \u00a0<\/p>\n<p>ACUERDO N\u00daMERO 05 DE 1993 \u00a0 \u00a0<\/p>\n<p>(febrero 9) \u00a0 \u00a0<\/p>\n<p>&#8220;por el cual se establece la Planta \u00a0de Personal del Instituto Los empleados p\u00fablicos que no sean incorporados en los cargos previstos en \u00a0la planta de personal que se establece en este acuerdo, quedar\u00e1n retirados del \u00a0servicio a partir de la vigencia del Decreto por el cual se aprueba el presente \u00a0Acuerdo, exceptuando los que prestan sus servicios en programas de fomento en \u00a0granjas de propagaci\u00f3n de material vegetativo y semillas en frutales de hoja \u00a0caduca, jardines clonales, viveros en caucho y frutales, en propagaci\u00f3n de \u00a0especies menores y alevinos en las Regiones del Valle del Cauca, Antiguo \u00a0Caldas, Antioquia, Magdalena Medio, Huila, Caquet\u00e1, Meta, Casanare, Boyac\u00e1 y \u00a0Arauca los cuales quedar\u00e1n retirados del servicio a partir del primero (1o.) de \u00a0Julio de 1993. \u00a0 \u00a0<\/p>\n<p>ARTICULO \u00a05o. Los empleados p\u00fablicos y trabajadores oficiales a quienes se les suprima el \u00a0cargo y que a 30 (treinta) de Junio de 1993, hayan cumplido con los requisitos \u00a0para tener derecho a pensi\u00f3n de jubilaci\u00f3n y que no sean incorporados en la \u00a0nueva planta de personal del INCORA, quedar\u00e1n desvinculados del Instituto a \u00a0partir del primero (1o.) de Julio de 1993, sin tener derecho a que se les \u00a0reconozca y pague las indemnizaciones o bonificaciones previstas en el Decreto 2137 de 1992, \u00a0tal como se establece en su art\u00edculo 14. \u00a0 \u00a0<\/p>\n<p>ARTICULO \u00a06o. Los trabajadores oficiales de la Regional Arauca quedar\u00e1n desvinculados del \u00a0Instituto por terminaci\u00f3n de los contratos de trabajo, a partir del 1o. de \u00a0Junio de 1993. \u00a0 \u00a0<\/p>\n<p>ARTICULO \u00a07o. Los funcionarios que sean incorporados como consecuencia de la \u00a0Reestructuraci\u00f3n, devengar\u00e1n el salario que les correspond\u00eda en la anterior \u00a0Planta de Personal, hasta el d\u00eda en que tomen posesi\u00f3n del cargo asignado en la \u00a0Nueva planta que se adopta con el presente Acuerdo. \u00a0 \u00a0<\/p>\n<p>PARAGRAFO. \u00a0La incorporaci\u00f3n en la Nueva Planta se efectuar\u00e1 dentro del t\u00e9rmino de quince \u00a0(15) d\u00edas calendario, contados a partir de la vigencia del Decreto que apruebe \u00a0este Acuerdo. \u00a0 \u00a0<\/p>\n<p>ARTICULO 8o.
