{"id":27583,"date":"2023-07-18T15:19:54","date_gmt":"2023-07-18T15:19:54","guid":{"rendered":"https:\/\/www.dmsjuridica.com\/buscador_20179478954\/legislacion\/decretos\/2023\/07\/18\/decreto-1147-de-1999\/"},"modified":"2023-07-18T15:19:54","modified_gmt":"2023-07-18T15:19:54","slug":"decreto-1147-de-1999","status":"publish","type":"post","link":"https:\/\/www.dmsjuridica.com\/buscador_20179478954\/legislacion\/decretos\/2023\/07\/18\/decreto-1147-de-1999\/","title":{"rendered":"DECRETO 1147 DE 1999"},"content":{"rendered":"\n<p>DECRETO 1147 DE 1999 \u00a0 \u00a0<\/p>\n<p>(junio 29) \u00a0 \u00a0<\/p>\n<p>por el cual \u00a0se establece la planta de personal de la Contralor\u00eda General de la Rep\u00fablica. \u00a0 \u00a0<\/p>\n<p>Nota 1: El Decreto 1214 de 1999, \u00a0art\u00edculo 3\u00ba hizo correcci\u00f3n de un yerro en este decreto. \u00a0 \u00a0<\/p>\n<p>Nota 2: Este Decreto fue declarado \u00a0inexequible por la Corte Constitucional en la Sentencia C-969 de 1999, \u00a0Providencia confirmada en la Sentencia C-996 de 1999. \u00a0 \u00a0<\/p>\n<p>El Presidente \u00a0de la Rep\u00fablica de Colombia en uso de las facultades extraordinarias conferidas \u00a0por el numeral 6 del art\u00edculo 120 de la Ley 489 de 1998, y \u00a0 \u00a0<\/p>\n<p>CONSIDERANDO: \u00a0 \u00a0<\/p>\n<p>Que el Gobierno Nacional escuch\u00f3 \u00a0el concepto del Contralor General de la Rep\u00fablica de que trata el par\u00e1grafo 4\u00ba \u00a0del art\u00edculo 120 de la Ley 489 de 1998. \u00a0 \u00a0<\/p>\n<p>Que analizadas las necesidades, \u00a0competencias y responsabilidades a cargo de \u00a0 \u00a0<\/p>\n<p>la Contralor\u00eda General de la Rep\u00fablica \u00a0es necesario establecer una planta de personal que permita el cumplimiento \u00a0eficiente y eficaz de la gesti\u00f3n a cargo de la Contralor\u00eda General de la \u00a0Rep\u00fablica, \u00a0 \u00a0<\/p>\n<p>DECRETA: \u00a0 \u00a0<\/p>\n<p>Supresi\u00f3n de empleos. El \u00a0Contralor General de la Rep\u00fablica, mediante resoluci\u00f3n, distribuir\u00e1 los cargos \u00a0de la planta de personal a que se refiere el presente decreto, teniendo en \u00a0cuenta la estructura interna, las necesidades del servicio, los planes, \u00a0programas, procesos, proyectos y pol\u00edticas. \u00a0 \u00a0<\/p>\n<p>El traslado de servidores \u00a0p\u00fablicos que implique cambio permanente de sede territorial se efectuar\u00e1 previa \u00a0consulta con la Comisi\u00f3n de Personal. \u00a0 \u00a0<\/p>\n<p>Grupos de trabajo. Con el fin de \u00a0atender las necesidades del servicio y cumplir con eficacia y eficiencia los \u00a0objetivos, las pol\u00edticas y los programas de la entidad, el Contralor General de \u00a0la Rep\u00fablica podr\u00e1 crear y organizar, con car\u00e1cter permanente o transitorio, \u00a0grupos internos de trabajo. \u00a0 \u00a0<\/p>\n<p>En el acto de creaci\u00f3n de tales \u00a0grupos se determinar\u00e1n las actividades que deber\u00e1n cumplir y las consiguientes \u00a0responsabilidades. \u00a0 \u00a0<\/p>\n<p>Incorporaci\u00f3n a la nueva planta. \u00a0La incorporaci\u00f3n de los empleados a la planta de personal adoptada por este \u00a0decreto, se efectuar\u00e1 conforme a las disposiciones legales sobre la materia \u00a0dentro de los seis (6) meses siguientes, contados a partir de la fecha de \u00a0publicaci\u00f3n del presente decreto. \u00a0 \u00a0<\/p>\n<p>Los empleados de la Contralor\u00eda \u00a0General de la Rep\u00fablica continuar\u00e1n percibiendo la remuneraci\u00f3n mensual \u00a0correspondiente a los empleos que desempe\u00f1an, hasta tanto se produzca su \u00a0incorporaci\u00f3n a la planta de personal establecida en el presente decreto y \u00a0tomen posesi\u00f3n del cargo. \u00a0 \u00a0<\/p>\n<p>El Contralor \u00a0General de la Rep\u00fablica podr\u00e1 efectuar incorporaciones parciales a la planta de \u00a0personal determinada en el presente decreto, caso en el cual los empleados \u00a0devengar\u00e1n la remuneraci\u00f3n correspondiente, desde la fecha en que se produzca \u00a0la posesi\u00f3n respectiva. \u00a0 \u00a0<\/p>\n<p>Incorporaci\u00f3n de los empleados \u00a0del Fondo de Bienestar. Los empleados asignados al Fondo de Bienestar Social de \u00a0la Contralor\u00eda General de la Rep\u00fablica continuar\u00e1n prestando sus servicios en \u00a0aquel, hasta tanto sea definida su incorporaci\u00f3n a la planta de personal que se \u00a0establezca para el Fondo. \u00a0 \u00a0<\/p>\n<p>Incorporaci\u00f3n o Indemnizaci\u00f3n. \u00a0Los empleados pertenecientes a la carrera administrativa de la Contralor\u00eda \u00a0General de la Rep\u00fablica a quienes se les suprime el cargo como consecuencia de \u00a0lo dispuesto en el art\u00edculo 1\u00ba del presente decreto, podr\u00e1n optar entre la \u00a0indemnizaci\u00f3n o la incorporaci\u00f3n de acuerdo con lo dispuesto en el r\u00e9gimen \u00a0especial de carrera administrativa de la Contralor\u00eda General de la Rep\u00fablica. \u00a0 \u00a0<\/p>\n<p>Vigencia.
