{"id":3104,"date":"2023-11-09T10:55:58","date_gmt":"2023-11-09T15:55:58","guid":{"rendered":"https:\/\/www.dmsjuridica.com\/buscador_20179478954\/legislacion\/leyes\/?p=3104"},"modified":"2023-11-09T10:55:58","modified_gmt":"2023-11-09T15:55:58","slug":"ley-51-de-1942","status":"publish","type":"post","link":"https:\/\/www.dmsjuridica.com\/buscador_20179478954\/legislacion\/leyes\/2023\/11\/09\/ley-51-de-1942\/","title":{"rendered":"LEY 51 DE 1942"},"content":{"rendered":"<p style=\"font-weight: 400;\"><strong>LEY 51 DE 1942<\/strong><\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">(DICIEMBRE 29 DE 1942)<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">Por la cual se reglamentan varias explotaciones industriales<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">EL CONGRESO DE COLOMBIA<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>DECRETA:<\/strong><\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>Articulo 1.\u00a0<\/strong>Los municipios proceder\u00e1n a suspender la explotaci\u00f3n de canteras, areneras y la elaboraci\u00f3n de materiales para construcci\u00f3n cuando de ello se derive peligro o perjuicio para las poblaciones, sus obras p\u00fablicas, las edificaciones particulares o las aguas de uso p\u00fablico.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">La resoluci\u00f3n sobre el particular deber\u00e1 fundamentarse en el concepto previo de peritos .<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>Articulo 2.\u00a0<\/strong>No podr\u00e1 concederse permiso para las explotaciones a que hace referencia el art\u00edculo anterior sin previo concepto favorable de peritos que acrediten la ausencia de los dichos peligros o perjuicios.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">El permiso deber\u00e1 otorgarse por medio de resoluci\u00f3n y en \u00e9sta se fijar\u00e1n las condiciones t\u00e9cnicas en que deba hacerse la explotaci\u00f3n.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">Par\u00e1grafo. La omisi\u00f3n de cualquiera de dichas condiciones, ocasionar\u00e1 el cierre de las explotaciones a que esta ley se refiere, m\u00e1s las multas legales que el municipio considere equitativas.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>Articulo 3.\u00a0<\/strong>Los propietarios de dichas empresas ser\u00e1n responsables ante los particulares o las entidades p\u00fablicas, seg\u00fan el caso, de todos los perjuicios que puedan ocasionarse en cualquier tiempo por tales explotaciones y aun cuando haya habido permiso.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>Articulo\u00a0 4.\u00a0<\/strong>Esta ley regir\u00e1 desde su sanci\u00f3n.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">Dada en Bogot\u00e1, D.
