C., veintitr\u00e9s (23) &nbsp;de octubre de mil novecientos noventa y siete (1997).- &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Ref: Expediente No. 4918 &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;Dec\u00eddese el recurso de casaci\u00f3n &nbsp;interpuesto &nbsp;por &nbsp;el &nbsp;demandante &nbsp;contra &nbsp;la &nbsp;sentencia &nbsp;de &nbsp;14 &nbsp;de diciembre de &nbsp;1993,&nbsp; &nbsp;proferida &nbsp;por &nbsp;el &nbsp;Tribunal &nbsp;Superior &nbsp;del &nbsp;Distrito &nbsp;Judicial &nbsp;de &nbsp;Villavicencio &nbsp;en &nbsp;el &nbsp;proceso &nbsp;ordinario &nbsp;de Domingo Prieto Le\u00f3n contra Gloria &nbsp;Isabel Espinoza Leguizam\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;I.&nbsp; Antecedentes &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1.&nbsp; &nbsp;El &nbsp;proceso &nbsp;tuvo &nbsp;venero &nbsp;en &nbsp;la &nbsp;demanda &nbsp;en que el actor &nbsp;solicit\u00f3 &nbsp;que &nbsp;se &nbsp;declare nula la promesa de compraventa que suscribi\u00f3 con la &nbsp;demandada &nbsp;el &nbsp;17 &nbsp;de mayo de 1978,&nbsp; y se disponga que los bienes objeto de &nbsp;ella &nbsp;vuelvan &nbsp;a &nbsp;sus &nbsp;respectivos &nbsp;due\u00f1os,&nbsp; &nbsp;\u00abmediante &nbsp;las restituciones &nbsp;mutuas\u00bb,&nbsp; &nbsp;incluyendo &nbsp;los &nbsp;frutos;&nbsp; y que se condene a la demandada a &nbsp;pagar los perjuicios dimanantes de la nulidad deprecada. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.&nbsp; &nbsp;El &nbsp;aspecto &nbsp;f\u00e1ctico &nbsp;de &nbsp;la pretensi\u00f3n,&nbsp; as\u00ed puede &nbsp;recapitularse: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Consisti\u00f3 el negocio en que el &nbsp;demandante &nbsp;prometi\u00f3 &nbsp;vender a la demandada la finca conformada por los predios &nbsp;\u00abCundinamarca, &nbsp;Santa &nbsp;Rosa y San Isidro\u00bb,&nbsp; de extensi\u00f3n aproximada de 200 &nbsp;hect\u00e1reas, &nbsp;ubicada &nbsp;en la vereda Santa Teresita del municipio de Medina,&nbsp; &nbsp;especificada &nbsp;como aparece en el primer hecho de la demanda.&nbsp; El precio fue &nbsp;de &nbsp;un &nbsp;mill\u00f3n &nbsp;de &nbsp;pesos,&nbsp; &nbsp;que &nbsp;se pagar\u00eda as\u00ed:&nbsp; con el veh\u00edculo &nbsp;(bus) &nbsp; &nbsp; all\u00ed &nbsp; &nbsp; tambi\u00e9n &nbsp; &nbsp; especificado,&nbsp; &nbsp; &nbsp;por &nbsp; &nbsp;un &nbsp; &nbsp;valor &nbsp; &nbsp;de &nbsp;$500.000.oo;&nbsp;&nbsp; &nbsp; la &nbsp; suma &nbsp; de &nbsp; $200.000.oo &nbsp; que &nbsp;la &nbsp;demandada &nbsp;se &nbsp;comprometi\u00f3 &nbsp;a &nbsp;pagar &nbsp;a &nbsp;la &nbsp;Caja &nbsp;Agraria;&nbsp; &nbsp;y &nbsp;el &nbsp;resto &nbsp;en &nbsp;dinero en &nbsp;efectivo. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\u00abEl&nbsp; &nbsp; plazo &nbsp;para &nbsp;dar &nbsp;cumplimiento &nbsp;al &nbsp;negocio &nbsp;era &nbsp;el &nbsp;22 &nbsp;de &nbsp;mayo de 1978\u00bb.&nbsp; Pero se omiti\u00f3 &nbsp;indicar &nbsp;la &nbsp;notar\u00eda donde se llevar\u00eda a cabo,&nbsp; am\u00e9n de que el documento &nbsp;\u00abcarece &nbsp; de &nbsp;la &nbsp;tradici\u00f3n &nbsp;titular &nbsp;para &nbsp;hacer &nbsp;viable &nbsp;el &nbsp;registro &nbsp;de &nbsp;la &nbsp;escritura\u00bb.&nbsp; &nbsp;Y se vici\u00f3 tambi\u00e9n el contrato porque la demandada \u00abno hizo &nbsp;el &nbsp;traspaso &nbsp;del &nbsp;veh\u00edculo\u00bb,&nbsp; &nbsp;y el actor no ha podido explotarlo por \u00abno &nbsp;tener &nbsp;la &nbsp;documentaci\u00f3n &nbsp;al &nbsp;d\u00eda\u00bb,&nbsp; &nbsp;ocasion\u00e1ndole &nbsp;un &nbsp;\u00abtremendo lucro &nbsp;cesante\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;3.&nbsp; &nbsp;Gloria &nbsp;Isabel &nbsp;no &nbsp;se &nbsp;opuso a la nulidad implorada y a la &nbsp;consiguiente &nbsp; restituci\u00f3n &nbsp;de &nbsp;lo &nbsp;que &nbsp;de &nbsp;su &nbsp;parte &nbsp;entreg\u00f3 &nbsp;(automotor &nbsp;y &nbsp;dinero);&nbsp; &nbsp; en &nbsp; cambio,&nbsp; &nbsp; pidi\u00f3 &nbsp; denegar &nbsp; la &nbsp; restituci\u00f3n &nbsp; del &nbsp;inmueble,&nbsp; &nbsp;\u00abporque &nbsp;su &nbsp;detentaci\u00f3n &nbsp;por &nbsp;parte de la demandada,&nbsp; en &nbsp;forma &nbsp;real &nbsp;y &nbsp;material, &nbsp;no &nbsp;tiene &nbsp;causa &nbsp;en &nbsp;el &nbsp;contrato sino por virtud de &nbsp;relaci\u00f3n &nbsp; jur\u00eddica &nbsp;con &nbsp;Tercero\u00bb,&nbsp; &nbsp;con &nbsp;fundamento &nbsp;en &nbsp;lo &nbsp;cual &nbsp;dijo &nbsp;excepcionar.&nbsp; &nbsp;Explic\u00f3 &nbsp;adicionalmente que la posesi\u00f3n material que tiene &nbsp;sobre &nbsp;la &nbsp;finca &nbsp;no le vino por efecto del convenio a anularse,&nbsp; sino \u00abpor &nbsp;compra &nbsp;y &nbsp;RECIBO &nbsp;DE &nbsp;MEJORAS hecha a Luis Antonio Beltr\u00e1n\u00bb.&nbsp; Y el predio &nbsp;denominado &nbsp; \u00abSamarkanda\u00bb,&nbsp; &nbsp; que &nbsp; hace &nbsp; parte &nbsp; del &nbsp;predio &nbsp;objeto &nbsp;del &nbsp;contrato,&nbsp; &nbsp;lo &nbsp;adquiri\u00f3 &nbsp;\u00abpor &nbsp;Adjudicaci\u00f3n &nbsp;que &nbsp;le &nbsp;hizo &nbsp;la Naci\u00f3n a &nbsp;t\u00edtulo &nbsp;de &nbsp;terreno &nbsp;bald\u00edo,&nbsp; &nbsp;mediante &nbsp;la Resoluci\u00f3n No. 1483 de 30 de &nbsp;noviembre &nbsp;de &nbsp;1.988 del Incora y registrada al folio de Matr\u00edcula Inmobiliaria &nbsp;No. 160-0019.555 de la Oficina de Registro de Gachet\u00e1\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;4.&nbsp; &nbsp;Mediante sentencia de 13 de abril de 1993,&nbsp; el juzgado &nbsp;segundo &nbsp; civil &nbsp; del &nbsp; circuito &nbsp; de &nbsp; Villavicencio &nbsp;puso &nbsp;fin &nbsp;a &nbsp;la &nbsp;primera &nbsp;instancia,&nbsp; &nbsp;en &nbsp;la &nbsp;que declar\u00f3 la nulidad impetrada y dijo que no hab\u00eda &nbsp;lugar &nbsp; a &nbsp; restituciones &nbsp; mutuas.&nbsp; &nbsp; Y,&nbsp; &nbsp;el &nbsp;Tribunal &nbsp;Superior &nbsp;de &nbsp;Villavicencio &nbsp; la &nbsp;confirm\u00f3 &nbsp;al &nbsp;desatar &nbsp;la &nbsp;apelaci\u00f3n &nbsp;interpuesta &nbsp;por &nbsp;el &nbsp;actor. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;5.&nbsp; &nbsp;La decisi\u00f3n del tribunal,&nbsp; como se dej\u00f3 dicho,&nbsp; &nbsp;fue recurrida en casaci\u00f3n por la misma parte. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;II.&nbsp; &nbsp; &nbsp; La &nbsp; &nbsp; sentencia &nbsp; &nbsp;del &nbsp;tribunal &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Historiado &nbsp;el &nbsp;litigio,&nbsp; &nbsp;puntualiz\u00f3 &nbsp;de entrada que el objeto de la apelaci\u00f3n en este caso no gira m\u00e1s &nbsp;que &nbsp; en &nbsp; torno &nbsp; a &nbsp; las &nbsp; prestaciones &nbsp;mutuas &nbsp;que &nbsp;efunden &nbsp;de &nbsp;la &nbsp;nulidad &nbsp;contractual. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Aplicado &nbsp;a tal punto,&nbsp; el &nbsp;sentenciador &nbsp;record\u00f3 &nbsp;la &nbsp;jurisprudencia &nbsp;de la Corte seg\u00fan la cual,&nbsp; de &nbsp;conformidad &nbsp;con &nbsp;el &nbsp;art. &nbsp;1746 del C. C., cada una de las partes devuelve a la &nbsp;otra \u00ablo que HA RECIBIDO como prestaci\u00f3n del contrato invalidado\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Entr\u00f3 entonces a enfatizar que &nbsp;la &nbsp;aplicaci\u00f3n &nbsp;de esa preceptiva legal,&nbsp; tiene como presupuesto necesario &nbsp;el &nbsp;que &nbsp;\u00ablas partes hayan cumplido con las prestaciones que el contrato anulado &nbsp;impon\u00eda &nbsp;a &nbsp;cada &nbsp;una de ellas,&nbsp; en el caso de la compraventa o promesa de &nbsp;ella,&nbsp; &nbsp;el que el vendedor haya entregado materialmente y realmente el bien &nbsp;objeto &nbsp; del &nbsp;contrato &nbsp;y &nbsp;el &nbsp;comprador &nbsp;pagado &nbsp;el &nbsp;precio &nbsp;acordado &nbsp;por &nbsp;las &nbsp;partes,&nbsp; &nbsp; como &nbsp;obligaciones &nbsp;principales &nbsp;que &nbsp;surgen &nbsp;para &nbsp;comprador &nbsp;y &nbsp;vendedor en esta clase de contratos\u00bb &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;En &nbsp; &nbsp;el &nbsp; &nbsp;sub-lite&nbsp;&nbsp; &nbsp;-dijo-&nbsp; &nbsp;\u00abno &nbsp;existe &nbsp;constancia &nbsp;o &nbsp;prueba &nbsp;alguna &nbsp;de &nbsp;que &nbsp;las &nbsp;partes hubieren cumplido la &nbsp;promesa\u00bb.&nbsp; &nbsp;El &nbsp;actor &nbsp;no &nbsp;demostr\u00f3 \u00abhaber hecho entrega del inmueble a la &nbsp;promitente &nbsp;compradora\u00bb;&nbsp; &nbsp;y &nbsp;\u00e9sta &nbsp;afirm\u00f3 &nbsp;y demostr\u00f3 que \u00abadquiri\u00f3 la &nbsp;posesi\u00f3n &nbsp;y &nbsp;posterior &nbsp;propiedad &nbsp;del mismo por medios diferentes a la entrega &nbsp;hecha por el ahora demandante\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp;De donde dedujo: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;\u00ab&#8230; as\u00ed las cosas,&nbsp; pues &nbsp;no &nbsp;pod\u00eda &nbsp;el &nbsp;a quo efectuar una condena gen\u00e9rica ni concretarla en base a la &nbsp;suposici\u00f3n &nbsp;de &nbsp;haber &nbsp;cumplido &nbsp;las &nbsp;partes &nbsp;con &nbsp;las &nbsp;prestaciones &nbsp;a &nbsp;que se &nbsp;comprometieron &nbsp;en &nbsp;el &nbsp;contrato;&nbsp; &nbsp;n\u00f3tese &nbsp;que &nbsp;el &nbsp;recaudo probatorio se &nbsp;limit\u00f3 &nbsp;a &nbsp;las &nbsp;documentales &nbsp;tra\u00eddas &nbsp;y a los dict\u00e1menes periciales que nada &nbsp;aclaran &nbsp;respecto &nbsp;a &nbsp;las &nbsp;entregas &nbsp;que &nbsp;las partes se hubieren hecho;&nbsp; la &nbsp;demandada &nbsp;en &nbsp;el &nbsp;interrogatorio &nbsp;absuelto &nbsp;en &nbsp;esta &nbsp;instancia &nbsp;insiste &nbsp;en su &nbsp;posici\u00f3n &nbsp;inicial &nbsp;y &nbsp;el demandado (sic) no asisti\u00f3 al interrogatorio de parte &nbsp;decretado ni justific\u00f3 su inasistencia\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;En &nbsp; el &nbsp;\u00fanico &nbsp;cargo &nbsp;que &nbsp;contiene,&nbsp; &nbsp;formulado &nbsp;al &nbsp;abrigo &nbsp;de &nbsp;la &nbsp;primera &nbsp;causal del art. 368 del &nbsp;c\u00f3digo &nbsp;de &nbsp;procedimiento civil, se denuncia la trasgresi\u00f3n del art\u00edculo 1746 &nbsp;del c\u00f3digo civil,&nbsp; por inaplicaci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp;El &nbsp; tribunal &nbsp; -dice &nbsp; el &nbsp;censor-,&nbsp; &nbsp;pese &nbsp;a &nbsp;que declar\u00f3 la nulidad del contrato,&nbsp; no decret\u00f3 &nbsp;\u00abla &nbsp;restituci\u00f3n de los bienes trabados en el proceso a su estado anterior a la &nbsp;convenci\u00f3n &nbsp;contractual &nbsp;a &nbsp;sus &nbsp;respectivos &nbsp;due\u00f1os y condenar al pago de los &nbsp;frutos civiles de la finca\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;M\u00e1s &nbsp;adelante &nbsp;explana &nbsp;el &nbsp;recurrente &nbsp;que &nbsp;el &nbsp;tribunal &nbsp;incurri\u00f3 &nbsp;en &nbsp;ese &nbsp;error de hecho,&nbsp; \u00abpor no &nbsp;apreciar &nbsp;las &nbsp;pruebas &nbsp;del &nbsp;proceso,&nbsp; &nbsp;por &nbsp;atenerse &nbsp;a &nbsp;los conceptos del &nbsp;a-quo,&nbsp; &nbsp;sin &nbsp;tomarse &nbsp;la molestia de asimilarlos en pro o en contra,&nbsp; &nbsp;se &nbsp;limit\u00f3 &nbsp;a &nbsp;reproducirlos,&nbsp; &nbsp;dejando de cumplir su misi\u00f3n revisora del &nbsp;fallo &nbsp;recurrido\u00bb.&nbsp; &nbsp;No &nbsp;apreci\u00f3 &nbsp;la &nbsp;contestaci\u00f3n &nbsp;de la demanda \u00abque no &nbsp;objeta &nbsp;el &nbsp;que &nbsp;no &nbsp;tenga &nbsp;la &nbsp;finca &nbsp;la demandada,&nbsp; sino que no la quiere &nbsp;entregar &nbsp; porque &nbsp; ya &nbsp; se &nbsp;la &nbsp;hizo &nbsp;adjudicar\u00bb;&nbsp;&nbsp; &nbsp;tampoco &nbsp;vio &nbsp;la &nbsp;inspecci\u00f3n &nbsp; judicial &nbsp; con &nbsp;peritaci\u00f3n,&nbsp; &nbsp;en &nbsp;la &nbsp;que &nbsp;se &nbsp;constat\u00f3 &nbsp;la &nbsp;detentaci\u00f3n &nbsp;de &nbsp;la &nbsp;finca &nbsp;por &nbsp;parte &nbsp;de &nbsp;Gloria &nbsp;Isabel,&nbsp; quien aparece &nbsp;usufructu\u00e1ndola.&nbsp; &nbsp;Para &nbsp;el &nbsp;recurrente,&nbsp; &nbsp;esto &nbsp;\u00faltimo &nbsp;es &nbsp;\u00abprueba &nbsp;palmaria\u00bb &nbsp;de &nbsp;que &nbsp;el &nbsp;actor s\u00ed le entreg\u00f3 la finca;&nbsp; pues se pregunta a &nbsp;s\u00ed:&nbsp; &nbsp;\u00abSi &nbsp;la &nbsp;demandada &nbsp;est\u00e1 &nbsp;cosechando &nbsp;la &nbsp;finca negociada,&nbsp; no &nbsp;demuestra &nbsp;que &nbsp;mi cliente se la entreg\u00f3?.&nbsp; Sin embargo,&nbsp; el tribunal &nbsp;dice que no hay prueba de dicha entrega. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;Consideraciones &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Como &nbsp;puede &nbsp;verse,&nbsp; &nbsp;el &nbsp;recurrente &nbsp; aspira &nbsp; a &nbsp; que &nbsp;le &nbsp;sea &nbsp;entregada &nbsp;la &nbsp;finca &nbsp;por &nbsp;v\u00eda &nbsp;de &nbsp;las &nbsp;\u201crestituciones &nbsp;mutuas\u201d&nbsp; &nbsp;que &nbsp;en &nbsp;su &nbsp;criterio &nbsp;deben &nbsp;derivarse &nbsp;como &nbsp;consecuencia &nbsp;de &nbsp;la nulidad de la promesa.&nbsp; A lo cual cumple precisar ante &nbsp;todo &nbsp;que&nbsp; &nbsp;si,&nbsp; &nbsp;como &nbsp;es &nbsp;exacto, &nbsp;la promesa de contrato apenas s\u00ed &nbsp;genera&nbsp; &nbsp;una &nbsp;obligaci\u00f3n &nbsp;de &nbsp;hacer,&nbsp; &nbsp;traducida &nbsp;en &nbsp;la celebraci\u00f3n &nbsp;posterior &nbsp;del &nbsp;contrato prometido,&nbsp; necesariamente hay que convenir en que &nbsp;la &nbsp;nulidad &nbsp;de &nbsp;ella &nbsp;no tiene por efecto propio sino hacer que desaparezca ese &nbsp;v\u00ednculo &nbsp;obligacional.&nbsp;&nbsp; La naturaleza misma de la obligaci\u00f3n que de &nbsp;all\u00ed &nbsp;brota,&nbsp; &nbsp;pues,&nbsp; est\u00e1 diciendo que,&nbsp; en caso de nulidad de &nbsp;la &nbsp;promesa,&nbsp; &nbsp;no &nbsp;es &nbsp;de &nbsp;la &nbsp;esencia &nbsp;concepto restitutorio alguno,&nbsp; &nbsp;porque &nbsp;la &nbsp;secuela de ella no ir\u00e1 m\u00e1s all\u00e1 de entender simplemente&nbsp; que &nbsp;ya &nbsp;para las partes dej\u00f3 de ser imperioso el tener que celebrar el contrato que &nbsp;tuvieron en mira.&nbsp; &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Otra &nbsp;cosa &nbsp;es &nbsp;que las partes &nbsp;acuerden &nbsp;en &nbsp;la &nbsp;promesa,&nbsp; &nbsp;como &nbsp;cosa &nbsp;de m\u00e1s, anticipar algunos efectos &nbsp;propios &nbsp;del contrato que prometen celebrar en el futuro, porque entonces,&nbsp; &nbsp;ante &nbsp; la &nbsp;nulidad &nbsp;de &nbsp;la &nbsp;promesa,&nbsp; &nbsp;es &nbsp;de &nbsp;recibo &nbsp;hablar &nbsp;de &nbsp;que &nbsp;los &nbsp;prometientes &nbsp;deban &nbsp;restituirse &nbsp;lo que hayan recibido en virtud de ella,&nbsp; &nbsp;precisamente &nbsp; &nbsp; cuando &nbsp; &nbsp; decidieron &nbsp; &nbsp; cumplir &nbsp; &nbsp; anteladamente &nbsp; &nbsp; algunas &nbsp;prestaciones. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;De lo cual &nbsp;resulta,&nbsp; &nbsp;como fiel trasunto,&nbsp; que es necesario recordar una vez m\u00e1s &nbsp;que &nbsp;no &nbsp;puede refundirse la obligaci\u00f3n propia de la promesa con las que surgen &nbsp;del &nbsp;contrato &nbsp;prometido.&nbsp; &nbsp;Anular &nbsp;una &nbsp;promesa &nbsp;de &nbsp;compraventa &nbsp;no es lo &nbsp;mismo,&nbsp; &nbsp; para &nbsp; efectos &nbsp;de &nbsp;restituciones &nbsp;mutuas,&nbsp; &nbsp;que &nbsp;anular &nbsp;la &nbsp;compraventa misma. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Hecha &nbsp; &nbsp;la &nbsp; &nbsp;anterior &nbsp;aclaraci\u00f3n,&nbsp; &nbsp;mem\u00f3rase &nbsp;que &nbsp;la &nbsp;raz\u00f3n &nbsp;que &nbsp;adujo &nbsp;el &nbsp;tribunal para no &nbsp;decretar &nbsp;las &nbsp;restituciones &nbsp;mutuas,&nbsp; &nbsp;fue &nbsp;la &nbsp;carencia de pruebas que le &nbsp;indicasen &nbsp;que &nbsp;las &nbsp;partes &nbsp;hubiesen &nbsp;entregado &nbsp;algo con ocasi\u00f3n del contrato &nbsp;anulado.&nbsp;&nbsp; &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Y &nbsp;vale &nbsp;la &nbsp;pena subrayar que &nbsp;dicha &nbsp;afirmaci\u00f3n &nbsp;la mantuvo auncuando vio que la demandada ten\u00eda la finca en &nbsp;su &nbsp; poder;&nbsp; &nbsp;lo &nbsp;que &nbsp;ocurri\u00f3 &nbsp;fue &nbsp;que &nbsp;no &nbsp;hall\u00f3 &nbsp;prueba &nbsp;de &nbsp;que &nbsp;tal &nbsp;detentaci\u00f3n &nbsp;hubiese &nbsp;devenido &nbsp;por &nbsp;entrega &nbsp;que &nbsp;le &nbsp;hiciera &nbsp;el &nbsp;prometiente &nbsp;vendedor;&nbsp; &nbsp; y &nbsp; s\u00ed,&nbsp; &nbsp; en &nbsp; cambio,&nbsp; &nbsp; que &nbsp; devino &nbsp; por &nbsp;v\u00eda &nbsp;diferente,&nbsp; &nbsp;conforme &nbsp;a &nbsp;lo &nbsp;que &nbsp;aleg\u00f3 &nbsp;la &nbsp;demandada &nbsp;al &nbsp;descorrer &nbsp;el &nbsp;traslado. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Conclusi\u00f3n &nbsp;obligada &nbsp;de &nbsp;lo &nbsp;anterior &nbsp;es que el sentenciador,&nbsp; contra lo que acusa el recurrente,&nbsp; &nbsp;s\u00ed &nbsp;vio &nbsp;que &nbsp;Gloria &nbsp;Isabel &nbsp;estaba &nbsp;en &nbsp;posesi\u00f3n de la finca.&nbsp; M\u00e1s que &nbsp;esto:&nbsp; &nbsp;lo vio a trav\u00e9s de la contestaci\u00f3n de la demanda y la inspecci\u00f3n &nbsp;judicial &nbsp;practicada &nbsp;con &nbsp;peritaci\u00f3n,&nbsp; &nbsp;justamente &nbsp;las pruebas en que se &nbsp;apoya el censor. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Es errada,&nbsp; pues,&nbsp; la &nbsp;formulaci\u00f3n &nbsp;del &nbsp;cargo,&nbsp; en cuanto enfil\u00f3 bater\u00edas respecto de un punto &nbsp;totalmente &nbsp;inexacto.&nbsp; &nbsp;Y,&nbsp; &nbsp;por &nbsp;contraste,&nbsp; &nbsp;dej\u00f3 &nbsp;de &nbsp;lado el &nbsp;proponer &nbsp;un &nbsp;ataque &nbsp;id\u00f3neo &nbsp;en casaci\u00f3n,&nbsp; comprendiendo naturalmente el &nbsp;argumento &nbsp;basilar &nbsp;del &nbsp;ad quem,&nbsp; que &nbsp; consisti\u00f3 &nbsp; en &nbsp;que &nbsp;tal &nbsp;posesi\u00f3n,&nbsp;&nbsp; &nbsp;-que &nbsp;s\u00ed &nbsp;vio,&nbsp; &nbsp;rep\u00edtese-,&nbsp;&nbsp; carec\u00eda de virtualidad para entender que el &nbsp;actor &nbsp;hab\u00edale &nbsp;entregado &nbsp;la finca a la demandada.&nbsp;&nbsp; Para decirlo en &nbsp;breve,&nbsp; &nbsp;demostrar que,&nbsp; contra lo que dijo el sentenciador,&nbsp; \u00e9l &nbsp;s\u00ed efectu\u00f3 dicha entrega. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Y &nbsp;el &nbsp;ataque id\u00f3neo no puede &nbsp;estar &nbsp;en la aseveraci\u00f3n de que si la demandada tiene la finca,&nbsp; es porque &nbsp;el &nbsp;actor &nbsp;se la entreg\u00f3.&nbsp; Pues que se trata de una deducci\u00f3n sin ning\u00fan &nbsp;soporte &nbsp;l\u00f3gico,&nbsp; &nbsp;comoquiera &nbsp;que &nbsp;la relaci\u00f3n de causa a efecto resulta &nbsp;asaz &nbsp; deleznable;&nbsp; &nbsp; tanto &nbsp; menos &nbsp; si,&nbsp; &nbsp;como &nbsp;lo &nbsp;dijo &nbsp;el &nbsp;propio &nbsp;tribunal,&nbsp; &nbsp;en &nbsp;el &nbsp;expediente &nbsp;obra &nbsp;prueba &nbsp;es de lo contrario:&nbsp; que &nbsp;Gloria &nbsp;Isabel &nbsp;entr\u00f3 en poder de la finca por \u201cmedios diferentes\u201d.&nbsp; Y &nbsp;much\u00edsimo &nbsp;menos &nbsp;que en esa afirmaci\u00f3n quepa un error de hecho,&nbsp; con las &nbsp;connotaciones que requiere la casaci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;No &nbsp; &nbsp; prospera &nbsp; &nbsp;el &nbsp;cargo. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;IV.&nbsp; Decisi\u00f3n &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;En virtud de lo expuesto,&nbsp; &nbsp;la &nbsp;Corte &nbsp;Suprema &nbsp;de &nbsp;Justicia,&nbsp; Sala de Casaci\u00f3n Civil y Agraria,&nbsp; &nbsp;administrando &nbsp;justicia &nbsp;en &nbsp;nombre &nbsp;de &nbsp;la &nbsp;Rep\u00fablica &nbsp;y &nbsp;por &nbsp;autoridad de la &nbsp;ley,&nbsp; &nbsp;no casa&nbsp; &nbsp;la &nbsp;sentencia de 14 de diciembre de 1993, proferida por el Tribunal Superior del &nbsp;Distrito &nbsp;Judicial &nbsp;de &nbsp;Villavicencio &nbsp;en &nbsp;este &nbsp;proceso de Domingo Prieto Le\u00f3n &nbsp;contra Gloria Isabel Espinosa Leguizam\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Costas en casaci\u00f3n a cargo del &nbsp;impugnante.&nbsp; T\u00e1sense. &nbsp;&nbsp;<\/p>\n<p>&nbsp;
