Expediente 5074 &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Despacha &nbsp;la Corte el Recurso extraordinario de &nbsp;Casaci\u00f3n &nbsp;propuesto &nbsp;por &nbsp;la &nbsp;parte &nbsp;demandante &nbsp;contra &nbsp;la &nbsp;sentencia del 7 de &nbsp;diciembre &nbsp;de &nbsp;1993, &nbsp;proferida &nbsp;por &nbsp;la &nbsp;Sala &nbsp;Civil &nbsp;del Tribunal Superior del &nbsp;Distrito &nbsp;Judicial &nbsp;de &nbsp;Santaf\u00e9 &nbsp;de &nbsp;Bogot\u00e1, &nbsp;dentro &nbsp;del proceso ordinario de &nbsp;pertenencia &nbsp;adelantado por LA JUNTA DE ACCION COMUNAL &nbsp;DEL &nbsp;BARRIO VENECIA DE SANTAFE DE BOGOTA, frente a las &nbsp;sociedades &nbsp; \u00abOSPINAS &nbsp; y &nbsp; Cia. &nbsp; S.A.\u00bb &nbsp;y &nbsp;\u00abPARTICIPACIONES &nbsp;LTDA\u00bb, &nbsp;y &nbsp;en &nbsp;el &nbsp;cual &nbsp;actu\u00f3, &nbsp;adem\u00e1s, &nbsp;EL &nbsp;DISTRITO &nbsp;CAPITAL &nbsp;DE &nbsp;SANTAFE &nbsp;DE BOGOTA como tercero &nbsp;interviniente. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;A N T E C E D E N T E S: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1. &nbsp;Impetr\u00f3 &nbsp;la &nbsp;parte actora que se declarara &nbsp;que &nbsp;le &nbsp;pertenece, &nbsp;por &nbsp;haberlo &nbsp;adquirido &nbsp;por &nbsp;prescripci\u00f3n &nbsp;extraordinaria &nbsp;adquisitiva &nbsp;de &nbsp;dominio, &nbsp;el inmueble determinado como zona A, sin nomenclatura &nbsp;definida &nbsp;y &nbsp;ubicado en el barrio Venecia de esta ciudad, el cual especifica por &nbsp;sus linderos en la correspondiente demanda. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2. &nbsp;Los &nbsp;supuestos &nbsp;f\u00e1cticos &nbsp;que conforman la &nbsp;\u00abcausa petendi\u00bb, pueden compendiarse de la siguiente forma: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;3. &nbsp;Las &nbsp;sociedades encausadas, enteradas de la &nbsp;demanda, &nbsp;se &nbsp;opusieron &nbsp;a las pretensiones all\u00ed contenidas. Dijeron desconocer &nbsp;varios &nbsp;de &nbsp;los &nbsp;hechos &nbsp;que &nbsp;la &nbsp;sustentan, &nbsp;negaron &nbsp;otros, &nbsp;y &nbsp;propusieron la &nbsp;excepci\u00f3n &nbsp;que &nbsp;denominaron &nbsp;\u00abimprocedencia de la declaraci\u00f3n de pertenencia\u00bb, &nbsp;la &nbsp;cual &nbsp;fundamentaron, &nbsp;b\u00e1sicamente, &nbsp;en que el inmueble pretendido es de uso &nbsp;p\u00fablico &nbsp;puesto &nbsp;que mediante escritura p\u00fablica No.3069 del 29 de diciembre de &nbsp;1989 &nbsp;lo &nbsp;transfirieron &nbsp;al &nbsp;Distrito Capital, aunque la afecci\u00f3n, como tal, se &nbsp;remonta &nbsp;al &nbsp;a\u00f1o &nbsp;de &nbsp;1961, &nbsp;tesis &nbsp;coadyuvada &nbsp;por esta entidad p\u00fablica en el &nbsp;escrito mediante el cual asent\u00f3 su tercer\u00eda. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;4. &nbsp;El &nbsp;Juzgado &nbsp;8\u00b0 &nbsp;Civil &nbsp;del &nbsp;Circuito &nbsp;de &nbsp;Santaf\u00e9 &nbsp;de &nbsp;Bogot\u00e1, &nbsp;al cual correspondi\u00f3 diligenciar la demanda, puso fin a &nbsp;la &nbsp;primera &nbsp;instancia &nbsp;mediante &nbsp;sentencia &nbsp;desestimatoria de las pretensiones, &nbsp;decisi\u00f3n &nbsp;que &nbsp;fue &nbsp;confirmada &nbsp;por la Sala Civil del Tribunal Superior de este &nbsp;Distrito &nbsp;Judicial, &nbsp;al &nbsp;despachar &nbsp;el &nbsp;recurso de apelaci\u00f3n interpuesto por la &nbsp;demandante. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;LA SENTENCIA DEL TRIBUNAL &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1.- &nbsp; Luego &nbsp; de &nbsp; relatar &nbsp;los &nbsp;antecedentes &nbsp;relevantes &nbsp;del &nbsp;litigio &nbsp;y &nbsp;de &nbsp;advertir la presencia cabal de los presupuestos &nbsp;procesales, &nbsp;repar\u00f3 &nbsp;el &nbsp;Tribunal en que se ejercit\u00f3 la acci\u00f3n de pertenencia &nbsp;por &nbsp;prescripci\u00f3n &nbsp;adquisitiva &nbsp;extraordinaria &nbsp;de dominio de un inmueble, cuya &nbsp;prosperidad, &nbsp;seg\u00fan la ley, supedit\u00f3 al lleno de los siguientes requisitos: a) &nbsp;Que &nbsp;verse &nbsp;sobre &nbsp;una cosa prescriptible; b) que se ejerza posesi\u00f3n pac\u00edfica, &nbsp;p\u00fablica &nbsp;e &nbsp;ininterrumpida, &nbsp;y &nbsp;c) &nbsp;que &nbsp;esa posesi\u00f3n haya durado un tiempo no &nbsp;inferior a 20 a\u00f1os. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;La &nbsp;regla &nbsp;general, &nbsp;agrega, &nbsp;es &nbsp;que se puede &nbsp;usucapir &nbsp;el &nbsp;dominio de los bienes corporales, ra\u00edces o muebles, que est\u00e1n en &nbsp;el &nbsp;comercio humano, motivo por el cual pod\u00edan prescribirse los bienes fiscales &nbsp;del &nbsp;Estado, &nbsp;dado que \u00fanicamente quedaron a salvo los de uso p\u00fablico. Empero, &nbsp;\u00abcon &nbsp;la &nbsp;expedici\u00f3n &nbsp;del &nbsp;decreto &nbsp;2282 de 1989\u00bb, el legislador sustrajo a los &nbsp;bienes &nbsp;de &nbsp;propiedad &nbsp;de las entidades de derecho p\u00fablico, tal como aparece en &nbsp;el art\u00edculo 407 del C\u00f3digo de Procedimiento Civil. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.- &nbsp;Se &nbsp;pregunta, &nbsp;entonces, &nbsp;el ad-quem &nbsp;si &nbsp;el bien en disputa \u00abes de &nbsp;uso &nbsp;p\u00fablico\u00bb, &nbsp;y &nbsp;encuentra &nbsp;que en la copia de la escritura No.3069 del 29 de &nbsp;diciembre &nbsp;de &nbsp;1989, &nbsp;otorgada &nbsp;ante &nbsp;la Notar\u00eda 24 del C\u00edrculo de Santaf\u00e9 de &nbsp;Bogot\u00e1, &nbsp;las &nbsp;sociedades &nbsp;demandadas &nbsp;cedieron &nbsp;a &nbsp;t\u00edtulo gratuito al Distrito &nbsp;Especial &nbsp;de &nbsp;Bogot\u00e1, &nbsp;hoy Distrito Capital de Santaf\u00e9 de Bogot\u00e1, el inmueble &nbsp;descrito &nbsp;en &nbsp;la demanda, a lo cual se suman el interrogatorio de parte absuelto &nbsp;por &nbsp;el &nbsp;Representante &nbsp;Legal &nbsp;de &nbsp;la parte demandante y la declaraci\u00f3n de SARA &nbsp;MARIA CAMARGO DE LEIVA. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Como &nbsp;se &nbsp;trata &nbsp;de &nbsp;un &nbsp;bien &nbsp;que &nbsp;no &nbsp;puede &nbsp;adquirirse &nbsp;por &nbsp;prescripci\u00f3n, concluye entonces&nbsp; el fallador diciendo que &nbsp;no &nbsp;se &nbsp;re\u00fane &nbsp;el &nbsp;primero de los presupuestos atr\u00e1s se\u00f1alados, raz\u00f3n por la &nbsp;cual &nbsp;encuentra &nbsp;\u201cinocuo analizar los testimonios, pues ellos no pueden suplir &nbsp;un requisito fundamental de la acci\u00f3n de pertenencia&#8230;\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;LA DEMANDA DE CASACION &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Como &nbsp;quiera &nbsp;que &nbsp;los &nbsp;dos &nbsp;cargos &nbsp;que &nbsp;ella &nbsp;contiene &nbsp;pudieron &nbsp;formularse &nbsp;en &nbsp;uno &nbsp;solo, la Corte, atendiendo lo dispuesto por el art\u00edculo 51 &nbsp;del &nbsp;decreto &nbsp;2651 &nbsp;de &nbsp;1991, &nbsp;cuya vigencia fue adoptada como definitiva por el &nbsp;art\u00edculo &nbsp;162 &nbsp;de &nbsp;la &nbsp;ley &nbsp;446 &nbsp;de &nbsp;1998, &nbsp;los integrar\u00e1 para despacharlos en &nbsp;conjunto. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1.- &nbsp;Se &nbsp;acusa &nbsp;en &nbsp;este &nbsp;cargo &nbsp;la &nbsp;sentencia &nbsp;impugnada &nbsp;de &nbsp;ser violatoria de los art\u00edculos 762, 981, 674, 2512, 2513, 2517, &nbsp;2518, &nbsp;2522, &nbsp;2527, &nbsp;2531, 2532 del C\u00f3digo Civil, por falta de aplicaci\u00f3n; del &nbsp;art\u00edculo &nbsp;2519 &nbsp;idem y el &nbsp;numeral &nbsp; 4\u00b0 &nbsp;del &nbsp;art\u00edculo &nbsp;407 &nbsp;del &nbsp;C\u00f3digo &nbsp;de &nbsp;Procedimiento &nbsp;Civil, &nbsp;por &nbsp;aplicaci\u00f3n &nbsp;indebida. &nbsp;Y &nbsp;del &nbsp;art\u00edculo 1\u00b0 de la ley 50 de 1936, normas todas &nbsp;estas &nbsp;infringidas &nbsp;como &nbsp;consecuencia &nbsp;de los siguientes errores de estimaci\u00f3n &nbsp;probatoria: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;a) En primer lugar, err\u00f3 de hecho el Tribunal &nbsp;al &nbsp;no &nbsp;darse &nbsp;cuenta &nbsp;que &nbsp;la escritura p\u00fablica No.3069 del 29 de diciembre de &nbsp;1989 &nbsp;de &nbsp;la &nbsp;Notar\u00eda &nbsp;24 &nbsp;de este c\u00edrculo notarial, fue otorgada cuando ya se &nbsp;hallaba &nbsp;en &nbsp;tr\u00e1mite &nbsp;este &nbsp;proceso ordinario de pertenencia. Error de la misma &nbsp;especie &nbsp;cometi\u00f3 el Tribunal, al no percatarse que la demanda fue presentada el &nbsp;13 &nbsp;de &nbsp;julio &nbsp;de &nbsp;1989 &nbsp;y &nbsp;fue &nbsp;admitida &nbsp;el &nbsp;10 &nbsp;de &nbsp;agosto de ese mismo a\u00f1o. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;b) &nbsp;As\u00ed &nbsp;mismo, tambi\u00e9n err\u00f3 el fallador al &nbsp;desfigurar &nbsp;en &nbsp;su fidelidad objetiva, la declaraci\u00f3n jurada del se\u00f1or ARMANDO &nbsp;DUPONT AVILA, representante legal de la entidad demandante. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.- &nbsp;Empe\u00f1ado &nbsp;ya &nbsp;en &nbsp;la &nbsp;sustentaci\u00f3n &nbsp;del &nbsp;cargo, &nbsp;afirma &nbsp;el &nbsp;recurrente &nbsp;que &nbsp;el &nbsp;Tribunal &nbsp;consider\u00f3 &nbsp;que &nbsp;por &nbsp;el mero &nbsp;otorgamiento &nbsp;del &nbsp;aludido &nbsp;instrumento &nbsp;p\u00fablico, el inmueble a que el mismo se &nbsp;refiere, &nbsp;adquiri\u00f3 &nbsp;la &nbsp;\u00abcategor\u00eda\u00bb &nbsp;de &nbsp;bien &nbsp;de &nbsp;uso p\u00fablico, sin observar, &nbsp;empero, &nbsp;que &nbsp;los &nbsp;cedentes &nbsp;afirmaron &nbsp;transmitir &nbsp;los &nbsp;derechos de propiedad y &nbsp;posesi\u00f3n &nbsp;que &nbsp;sobre &nbsp;el &nbsp;mismo &nbsp;ten\u00edan, pero es obvio que tales sociedades no &nbsp;tienen &nbsp;ni han tenido desde hace m\u00e1s de 20 a\u00f1os su posesi\u00f3n, como lo acredita &nbsp;el &nbsp;documento &nbsp;que obra de los folio 77 a 184 del cuaderno dos, el cual tambi\u00e9n &nbsp;ignor\u00f3 el sentenciador. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.1.- &nbsp;La &nbsp;posesi\u00f3n &nbsp;de &nbsp;los &nbsp;\u00abdemandantes\u00bb, &nbsp;agrega, &nbsp;se &nbsp;inici\u00f3 &nbsp;en &nbsp;junio &nbsp;de 1967, raz\u00f3n por la cual en junio de 1987 se &nbsp;cumplieron &nbsp;20 a\u00f1os de posesi\u00f3n material, p\u00fablica y pac\u00edfica, situaci\u00f3n que &nbsp;conduce &nbsp;a &nbsp;que al cumplirse el per\u00edodo de tiempo previsto en la ley, la actora &nbsp;adquiri\u00f3 &nbsp;el &nbsp;inmueble &nbsp;por &nbsp;prescripci\u00f3n &nbsp;adquisitiva &nbsp;de &nbsp;dominio, seg\u00fan lo &nbsp;preceptuado &nbsp;por &nbsp;los &nbsp;art\u00edculos &nbsp;2531 &nbsp;y &nbsp;2532 &nbsp;del &nbsp;C.C., &nbsp;en armon\u00eda con el &nbsp;art\u00edculo &nbsp;1\u00b0 &nbsp;de &nbsp;la ley 50 de 1936. Quiere esto decir, que cuando se admiti\u00f3 &nbsp;la &nbsp;demanda el derecho ya estaba consolidado en cabeza de la entidad demandante, &nbsp;motivo &nbsp;por &nbsp;el &nbsp;cual el Tribunal no pod\u00eda razonar que se trataba de un bien de &nbsp;uso &nbsp;p\u00fablico &nbsp;o &nbsp;un &nbsp;bien &nbsp;fiscal &nbsp;pues &nbsp;la &nbsp;escritura &nbsp;p\u00fablica &nbsp;de cesi\u00f3n es &nbsp;posterior &nbsp;a la presentaci\u00f3n y admisi\u00f3n de la demanda, olvidando, de paso, que &nbsp;el &nbsp; que &nbsp; nada &nbsp;tiene &nbsp;nada &nbsp;transfiere &nbsp;como &nbsp;se &nbsp;infiere &nbsp;del &nbsp;art\u00edculo &nbsp;752 &nbsp;ib\u00eddem, &nbsp; norma &nbsp; que &nbsp;tampoco fue aplicada. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.2.- &nbsp;El &nbsp;art\u00edculo &nbsp;674 &nbsp;del &nbsp;C\u00f3digo Civil, &nbsp;a\u00f1ade, &nbsp;llama &nbsp;bienes &nbsp;de &nbsp;la &nbsp;Uni\u00f3n &nbsp;a aquellos cuyo dominio corresponde a la &nbsp;Rep\u00fablica, &nbsp;y &nbsp;si &nbsp;puede &nbsp;ser &nbsp;usado &nbsp;por &nbsp;todos &nbsp;los habitantes del territorio &nbsp;nacional, &nbsp;como &nbsp;sucede &nbsp;con &nbsp;las &nbsp;calles, &nbsp;plazas, &nbsp;puentes, etc., se denominan &nbsp;bienes &nbsp;de &nbsp;la Uni\u00f3n de uso p\u00fablico o bienes p\u00fablicos del territorio. En este &nbsp;proceso &nbsp;no &nbsp;se encuentra ninguna prueba que acredite que el inmueble pretendido &nbsp;sea &nbsp;de tal especie, como tampoco de que se trate de un bien fiscal pues ninguna &nbsp;prueba demuestra que el Distrito ejerciera posesi\u00f3n sobre \u00e9l. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.3.- &nbsp;Concluye el recurrente afirmando: \u00abPero &nbsp;ni &nbsp;siquiera &nbsp;se &nbsp;haya &nbsp;(sic.) &nbsp;demostrado &nbsp;que &nbsp;el &nbsp;bien &nbsp;materia de esta litis &nbsp;corresponda &nbsp;a &nbsp;los &nbsp;bienes descritos en el instrumento p\u00fablico que habla de la &nbsp;donaci\u00f3n &nbsp; entre &nbsp;vivos&#8230;\u00bb. &nbsp;Como &nbsp;el &nbsp;Tribunal &nbsp;no &nbsp;repar\u00f3 &nbsp;en &nbsp;todas &nbsp;estas &nbsp;circunstancias, &nbsp;declar\u00f3 &nbsp;que el bien era de uso p\u00fablico y por consiguiente no &nbsp;susceptible de adquirirse por prescripci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;SEGUNDO CARGO &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1.- &nbsp;Se acusa en \u00e9l la sentencia recurrida de &nbsp;violar &nbsp;los &nbsp;art\u00edculos 762, 981, 674, 2512, 2513, 2517, 2518, 2522, 2527, 2531, &nbsp;2532 &nbsp; del &nbsp; C\u00f3digo &nbsp; Civil, &nbsp;por &nbsp;falta &nbsp;de &nbsp;aplicaci\u00f3n; &nbsp;el &nbsp;art\u00edculo &nbsp;2519 &nbsp;idem y el numeral 4\u00b0 del &nbsp;art\u00edculo &nbsp;407 &nbsp;del C\u00f3digo de Procedimiento Civil, por aplicaci\u00f3n indebida. El &nbsp;art\u00edculo &nbsp;1\u00b0 &nbsp;de &nbsp;la ley 50 de 1936, y de los art\u00edculos 187 y 228 del C\u00f3digo &nbsp;de Procedimiento Civil por falta de aplicaci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2.- &nbsp;Para fundamentar la acusaci\u00f3n, afirma el &nbsp;censor &nbsp;que &nbsp;el Tribunal cometi\u00f3 error de hecho al desconocer&nbsp; \u00abel texto y &nbsp;contexto\u00bb &nbsp;de la declaraci\u00f3n de parte de ARMANDO DUPONT AVILA, quien relata que &nbsp;la &nbsp;Junta &nbsp;de &nbsp;Acci\u00f3n &nbsp;Comunal &nbsp;por &nbsp;\u00e9l representada, hizo rellenar el terreno &nbsp;materia &nbsp;de &nbsp;la &nbsp;demanda, &nbsp;lo defendi\u00f3 de varias invasiones, y, adem\u00e1s, que el &nbsp;predio &nbsp;siempre ha estado bajo el control de la demandante desde el a\u00f1o de 1967 &nbsp;hasta la fecha en que rindi\u00f3 declaraci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;3.- &nbsp;Tampoco se percat\u00f3 el fallador, prosigue &nbsp;la &nbsp;censura, &nbsp;del testimonio de JORGE ENRIQUE VILLAMARIN CORREDOR, quien expresa &nbsp;que &nbsp;hace &nbsp;m\u00e1s de 20 a\u00f1os la Junta hizo arreglos al lote, inclusive lo fumig\u00f3 &nbsp;con &nbsp;petr\u00f3leo &nbsp;para &nbsp;\u00abacabar &nbsp;con &nbsp;los &nbsp;sancudos &nbsp;(sic.) &nbsp;y &nbsp;otras plagas\u00bb, que &nbsp;rellen\u00f3 &nbsp;un &nbsp;ca\u00f1o &nbsp;de aguas negras, utilizando 400 o 500 \u00abviajes\u00bb de recebo, y &nbsp;que solicit\u00f3 del Distrito una aplanadora para asentar el lote. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;4.- Tampoco apreci\u00f3 el Tribunal el testimonio &nbsp;de &nbsp;ELICIO &nbsp;INFANTE &nbsp;VILLARRAGA, &nbsp;quien &nbsp;dijo &nbsp;que &nbsp;la &nbsp;Junta &nbsp;hizo rellenar ese &nbsp;lote&nbsp; &nbsp;\u00abcon &nbsp;unas &nbsp;700 bolquetadas (sic.) de tierra y de recebo, que muchas &nbsp;veces &nbsp;gentes &nbsp;inexcrupulosas &nbsp;(sic.) &nbsp;lo &nbsp;intentaron &nbsp;invadir pero que la Junta &nbsp;evit\u00f3 &nbsp; la &nbsp; invasi\u00f3n&#8230;\u00bb, &nbsp;convirti\u00e9ndolo &nbsp;en &nbsp;parqueadero, &nbsp;construy\u00e9ndole &nbsp;mejoras y comport\u00e1ndose como due\u00f1a. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;5.- Tambi\u00e9n omiti\u00f3 apreciar el testimonio de &nbsp;JESUS &nbsp;MANUEL &nbsp;VALBUENA &nbsp;LOPEZ, &nbsp;a\u00f1ade &nbsp;el recurrente, quien afirma conocer ese &nbsp;lote &nbsp;desde &nbsp;1954 y constarle que era un basurero por el que corr\u00eda un ca\u00f1o de &nbsp;aguas &nbsp;negras &nbsp;y que en el a\u00f1o de 1968, \u00abentraron en posesi\u00f3n de el porque iba &nbsp;a &nbsp;venir &nbsp;el &nbsp;Papa&#8230;\u00bb, que despu\u00e9s la Junta lo arrend\u00f3 a MARIO GONZALEZ y \u00e9l &nbsp;lo replan\u00f3 us\u00e1ndolo como parqueadero. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;6.- &nbsp;Err\u00f3 tambi\u00e9n el Juzgador al no tener en &nbsp;cuenta &nbsp;la &nbsp;sentencia &nbsp;del 11 de septiembre de 1984, proferida por el juzgado 28 &nbsp;Civil &nbsp;del &nbsp;Circuito &nbsp;de esta ciudad en donde el Juez neg\u00f3 por prescripci\u00f3n la &nbsp;acci\u00f3n &nbsp;posesoria &nbsp;impetrada por las sociedades demandadas. Tampoco apreci\u00f3 el &nbsp;testimonio &nbsp;de &nbsp;EMPERATIZ &nbsp;DUQUE &nbsp;de &nbsp;MAYORGA, &nbsp;quien afirma que ese lote era un &nbsp;basurero &nbsp;y &nbsp;que &nbsp;la &nbsp;Junta &nbsp;tom\u00f3 &nbsp;posesi\u00f3n &nbsp;de &nbsp;\u00e9l &nbsp;e hizo obras de relleno. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;7.- &nbsp; Emprende &nbsp;la &nbsp;sustentaci\u00f3n &nbsp;del &nbsp;cargo &nbsp;manifestando &nbsp;que de haber analizado el Tribunal tales medios de prueba, habr\u00eda &nbsp;visto &nbsp;que la demandante realiz\u00f3 todos aquellos actos que denotan se\u00f1or\u00edo sin &nbsp;reconocer &nbsp;dominio &nbsp;ajeno &nbsp;a &nbsp;partir &nbsp;de &nbsp;1967. &nbsp;El &nbsp;Tribunal, &nbsp;con el argumento &nbsp;equivocado &nbsp;de &nbsp;que \u00abel bien es de USO PUBLICO\u00bb, no quiso examinar los medios de &nbsp;prueba &nbsp;que &nbsp;acreditan &nbsp;los &nbsp;hechos &nbsp;posesorios &nbsp;de la entidad actora, ni se dio &nbsp;cuenta &nbsp;que &nbsp;cuando &nbsp;estos &nbsp;comenzaron &nbsp;el bien no era de \u00abuso p\u00fablico\u00bb, es que &nbsp;nunca &nbsp;lo &nbsp;ha &nbsp;sido, &nbsp;como lo acreditan los documentos que obran al folio 77 del &nbsp;cuaderno &nbsp;2, &nbsp;porque &nbsp;si bien la sentencia no es medio de prueba, si permite, en &nbsp;este &nbsp;caso, &nbsp;inferir &nbsp;que las sociedades demandadas dijeron, con miras a obtener &nbsp;el &nbsp;amparo &nbsp;posesorio que deprecaban que eran las poseedoras del inmueble, luego &nbsp;este no era de uso p\u00fablico. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Cuando &nbsp;tales &nbsp;sociedades, &nbsp;contin\u00faa, dijeron &nbsp;donar &nbsp;el &nbsp;lote &nbsp;al &nbsp;Distrito, &nbsp;este ya hab\u00eda salido de su patrimonio porque su &nbsp;derecho &nbsp; de &nbsp; dominio &nbsp;ya &nbsp;se &nbsp;hab\u00eda &nbsp;extinguido &nbsp;por &nbsp;haberlo &nbsp;adquirido &nbsp;por &nbsp;prescripci\u00f3n &nbsp; la &nbsp; demandante, &nbsp; como &nbsp; lo &nbsp; dispone &nbsp;el &nbsp;art\u00edculo &nbsp;2538 &nbsp;del &nbsp;C.C. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Incurri\u00f3 &nbsp;en &nbsp;error el fallador al considerar &nbsp;que &nbsp;por &nbsp;el solo otorgamiento de la escritura p\u00fablica 3069 del 29 de diciembre &nbsp;de &nbsp;1989, &nbsp;los &nbsp;bienes &nbsp;a &nbsp;los cuales ese instrumento se refieren adquirieron la &nbsp;calidad &nbsp;de &nbsp;\u00abbienes &nbsp;de &nbsp;uso &nbsp;p\u00fablico\u00bb, &nbsp;con lo cual el Tribunal quebrant\u00f3 el &nbsp;art\u00edculo &nbsp;674 &nbsp;ib\u00eddem, &nbsp;pues &nbsp;un &nbsp;bien es de tal especie cuando re\u00fane los requisitos se\u00f1alados en esta &nbsp;norma, &nbsp;no &nbsp;advirtiendo, &nbsp;entonces, que la suscripci\u00f3n de la escritura p\u00fablica &nbsp;no &nbsp;tiene &nbsp;la &nbsp;\u00abvirtualidad &nbsp;autom\u00e1tica\u00bb para convertir un predio que antes era &nbsp;particular &nbsp;en un bien de uso p\u00fablico, m\u00e1xime cuando se encuentra pose\u00eddo por &nbsp;terceras personas que lo han adquirido por prescripci\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Tampoco &nbsp;se &nbsp;ha &nbsp;demostrado que en el inmueble &nbsp;pretendido &nbsp;existan &nbsp;calles, &nbsp;plazas &nbsp;o &nbsp;puentes &nbsp;de &nbsp;uso p\u00fablico, como tampoco &nbsp;pod\u00eda &nbsp;considerar &nbsp;el &nbsp;Tribunal &nbsp;que &nbsp;el &nbsp;bien &nbsp;fue &nbsp;destinado &nbsp;por la sociedad &nbsp;\u00abOSPINAS &nbsp;Y &nbsp;CIA S.A.\u00bb para el servicio de la comunidad, errores todos estos que &nbsp;le impidieron al Juzgador estimar las referidas pruebas. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;C &nbsp; O &nbsp; N &nbsp; S &nbsp; I &nbsp; D &nbsp; E &nbsp; R &nbsp; A &nbsp; C &nbsp; I &nbsp; O &nbsp;N &nbsp;E &nbsp;S: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;1. &nbsp;Parece &nbsp;menester recordar una vez m\u00e1s que &nbsp;la &nbsp;legislaci\u00f3n, &nbsp;en &nbsp;lo &nbsp;relativo &nbsp;a &nbsp;la &nbsp;adquisici\u00f3n de los derechos reales, &nbsp;particularmente &nbsp;el &nbsp;de &nbsp;dominio, &nbsp;exige &nbsp;la conjugaci\u00f3n del t\u00edtulo y el modo, &nbsp;entendi\u00e9ndose &nbsp;por &nbsp;el &nbsp;primero &nbsp;\u201cel &nbsp;hecho &nbsp;del &nbsp;hombre o la sola ley que lo &nbsp;faculta &nbsp;para &nbsp;la &nbsp;adquisici\u00f3n\u201d &nbsp;de &nbsp;esa especie de derechos, mientras que el &nbsp;segundo &nbsp;consiste &nbsp;en &nbsp;aquel &nbsp;mecanismo &nbsp;mediante &nbsp;el cual se realiza el t\u00edtulo &nbsp;cuando \u00e9ste da lugar a su adquisici\u00f3n. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Dest\u00e1case &nbsp;as\u00ed &nbsp;mismo &nbsp;que, por disposici\u00f3n &nbsp;del &nbsp;art\u00edculo &nbsp;673 &nbsp;del C\u00f3digo Civil, los modos de adquirir el dominio, \u201cson &nbsp;la &nbsp;ocupaci\u00f3n, &nbsp;la accesi\u00f3n, la tradici\u00f3n, la sucesi\u00f3n por causa de muerte y &nbsp;la &nbsp;prescripci\u00f3n\u201d, &nbsp;siendo este \u00faltimo un modo de adquirir el dominio de las &nbsp;cosas &nbsp;por &nbsp;su &nbsp;posesi\u00f3n &nbsp;durante &nbsp;el &nbsp;t\u00e9rmino y en las condiciones que la ley &nbsp;se\u00f1ala &nbsp;y que, en cuanto tal, se consolida de manera independiente de cualquier &nbsp;relaci\u00f3n &nbsp;precedente, siempre y cuando, en trat\u00e1ndose de la extraordinaria, se &nbsp;re\u00fanan &nbsp;los &nbsp;siguientes &nbsp;presupuestos: &nbsp;a) &nbsp;Que &nbsp;la &nbsp;cosa &nbsp;sea &nbsp;susceptible &nbsp;de &nbsp;adquirirse &nbsp;por &nbsp;prescripci\u00f3n; &nbsp;b) &nbsp;que &nbsp;el &nbsp;bien haya sido pose\u00eddo durante el &nbsp;t\u00e9rmino &nbsp;de &nbsp;20 &nbsp;a\u00f1os; &nbsp;y, &nbsp;c) &nbsp;que la posesi\u00f3n sea ininterrumpida. Reunidos, &nbsp;pues, &nbsp;estos &nbsp;requisitos &nbsp;puede &nbsp;decirse &nbsp;del &nbsp;poseedor &nbsp;que &nbsp;ha &nbsp;adquirido &nbsp;por &nbsp;prescripci\u00f3n &nbsp;extraordinaria &nbsp;un &nbsp;predio &nbsp;y, por tal raz\u00f3n, que es propietario &nbsp;del mismo. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Debe &nbsp;concluirse, &nbsp;subsecuentemente, &nbsp;que &nbsp;la &nbsp;sentencia &nbsp;que &nbsp;se profiera dentro del juicio de pertenencia correspondiente, es &nbsp;de &nbsp; car\u00e1cter &nbsp;meramente &nbsp;declarativo, &nbsp;o &nbsp;sea &nbsp;que&nbsp; &nbsp;est\u00e1 &nbsp;encaminada &nbsp;a &nbsp;reconocer &nbsp;jur\u00eddicamente &nbsp;una &nbsp;situaci\u00f3n &nbsp;f\u00e1ctica preexistente que no resulta &nbsp;alterada &nbsp;por &nbsp;la decisi\u00f3n judicial que as\u00ed lo admita. De ah\u00ed que se diga que &nbsp;se &nbsp;hace &nbsp;propietario &nbsp;de &nbsp;un inmueble por usucapi\u00f3n, quien se encuentre en las &nbsp;circunstancias &nbsp; atr\u00e1s &nbsp; se\u00f1aladas, &nbsp;independientemente &nbsp;de &nbsp;que &nbsp;se &nbsp;le &nbsp;haya &nbsp;declarado &nbsp;judicialmente &nbsp;como &nbsp;tal &nbsp;o &nbsp;no. De igual modo, la inscripci\u00f3n de la &nbsp;sentencia &nbsp;estimatoria &nbsp;de &nbsp;las &nbsp;pretensiones &nbsp;del &nbsp;poseedor &nbsp;en &nbsp;la &nbsp;Oficina de &nbsp;Registro &nbsp;pertinente, &nbsp;tiene &nbsp;una &nbsp;preponderante &nbsp;finalidad de publicidad que le &nbsp;permite &nbsp;al &nbsp;poseedor &nbsp;legitimarse &nbsp;para &nbsp;actuar &nbsp;en &nbsp;el tr\u00e1fico jur\u00eddico como &nbsp;due\u00f1o, &nbsp;generando, &nbsp;por &nbsp;tanto, &nbsp;la seguridad suficiente frente a los terceros, &nbsp;quienes, &nbsp;en &nbsp;ese orden de ideas, podr\u00e1n tener certeza de la calidad con la que &nbsp;obra &nbsp;el actor, sin que pueda decirse, entonces, que esa inscripci\u00f3n ostente el &nbsp;car\u00e1cter &nbsp;de &nbsp;tradici\u00f3n, &nbsp;desde &nbsp;luego &nbsp;que, &nbsp;como &nbsp;es &nbsp;palpable, &nbsp;se trata de &nbsp;distintos &nbsp;modos &nbsp;de adquirir el dominio, pues mientras \u00e9sta, la tradici\u00f3n, es &nbsp;la &nbsp;forma como se cumplen las obligaciones que tienen por objeto prestaciones de &nbsp;dar, &nbsp;la usucapi\u00f3n&nbsp; es la forma de hacerse due\u00f1o mediante la posesi\u00f3n en &nbsp;los &nbsp;t\u00e9rminos &nbsp;y &nbsp;circunstancias prescritos por la ley, de manera que cuando se &nbsp;profiere &nbsp;la &nbsp;sentencia estimatoria de las pretensiones del actor, el modo ya se &nbsp;ha operado mediante la prescripci\u00f3n adquisitiva. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;\u00abComo &nbsp;es &nbsp;ampliamente &nbsp;conocido &nbsp;-ha dicho la &nbsp;Corte-, &nbsp;reunidos &nbsp;los &nbsp;requisitos legales para la operancia de la prescripci\u00f3n &nbsp;adquisitiva, &nbsp;ella &nbsp;\u2018se &nbsp;efect\u00faa &nbsp;por ministerio de la ley una vez pose\u00eddo el mueble o ra\u00edz durante el &nbsp;tiempo &nbsp; &nbsp; que &nbsp; &nbsp; establece &nbsp; &nbsp; la &nbsp; &nbsp; ley &nbsp; &nbsp; en &nbsp; &nbsp; cada &nbsp; &nbsp; caso\u2019, &nbsp;cual &nbsp;lo &nbsp;tiene &nbsp;dicho &nbsp;la Corte &nbsp;Suprema &nbsp;de &nbsp;Justicia, &nbsp;en &nbsp;sentencia de casaci\u00f3n del 1\u00b0 de mayo de 1928, G.J. &nbsp;XXXV, &nbsp;p\u00e1g. &nbsp;254. &nbsp;Es &nbsp;decir, que la jurisdicci\u00f3n del Estado, por conducto del &nbsp;funcionario &nbsp;competente, &nbsp;no &nbsp;crea con la sentencia que en el respectivo proceso &nbsp;de &nbsp;pertenencia se profiera, el derecho real que ya hab\u00eda sido adquirido por el &nbsp;prescribiente &nbsp;si &nbsp;este &nbsp;as\u00ed &nbsp;lo &nbsp;demuestra, &nbsp;sino que tan solo tiene car\u00e1cter &nbsp;declarativo&nbsp; &nbsp;del &nbsp;mismo, &nbsp;jam\u00e1s &nbsp;constitutivo &nbsp;del &nbsp;derecho.\u00bb &nbsp;(G.J. &nbsp;219 &nbsp;pag.332). &nbsp;Esta &nbsp;que &nbsp;ha sido la doctrina constante de la Corte, la ha reiterado &nbsp;en &nbsp;distintas &nbsp;sentencias &nbsp;de &nbsp;casaci\u00f3n, &nbsp;entre otras, en la de 7 de octubre de &nbsp;1997 y 6 de abril de 1999. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;2. &nbsp;Si &nbsp;las cosas son como acaba de ponerse de &nbsp;presente, &nbsp;es &nbsp;decir, &nbsp;que &nbsp;el &nbsp;poseedor &nbsp;adquiere &nbsp;el &nbsp;dominio &nbsp;del bien cuando &nbsp;completa &nbsp;el &nbsp;t\u00e9rmino &nbsp;de posesi\u00f3n exigido por la ley, en las circunstancias y &nbsp;con &nbsp;los &nbsp;requisitos &nbsp;que \u00e9sta se\u00f1ale e independientemente de la sentencia que &nbsp;as\u00ed &nbsp;lo &nbsp;declare, era indispensable determinar en este asunto, si para la fecha &nbsp;en &nbsp;la &nbsp;que el titular inscrito cedi\u00f3 su derecho de domino sobre el inmueble al &nbsp;Distrito, &nbsp;el &nbsp;poseedor &nbsp;demandante alegaba haber consolidado ya el derecho cuyo &nbsp;reconocimiento reclama en la demanda. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Y &nbsp;no cabe duda en este punto, que el Tribunal &nbsp;pas\u00f3 &nbsp;por &nbsp;alto &nbsp;que &nbsp;para &nbsp;la &nbsp;\u00e9poca &nbsp;en que fue otorgada (29 de diciembre de &nbsp;1989), &nbsp;e &nbsp;inscrita (25 de enero de 1990) la escritura de cesi\u00f3n del predio, el &nbsp;actor &nbsp;no solo aduc\u00eda haber consolidado su derecho, sino que, inclusive, hab\u00eda &nbsp;presentado &nbsp;ya la demanda de pertenencia, incurriendo de ese modo en el error de &nbsp;facto &nbsp;que &nbsp;se &nbsp;le atribuye, yerro que lo llev\u00f3 a sostener con cierta ligereza, &nbsp;que &nbsp;como &nbsp;las &nbsp;sociedades demandadas lo hab\u00edan cedido al Distrito, era un bien &nbsp;de &nbsp;\u00abuso &nbsp;p\u00fablico\u00bb, sin reparar en que tal aseveraci\u00f3n s\u00f3lo era posible en la &nbsp;medida &nbsp;en &nbsp;que &nbsp;tuviera &nbsp;por &nbsp;cierto &nbsp;que &nbsp;la &nbsp;aludida &nbsp;escritura de cesi\u00f3n se &nbsp;suscribi\u00f3 &nbsp;y &nbsp;registr\u00f3 &nbsp;con &nbsp;anterioridad al afianzamiento del dominio alegado &nbsp;por &nbsp;la &nbsp;actora, &nbsp;pues, &nbsp;como &nbsp;ha &nbsp;quedado &nbsp;dicho, &nbsp;el &nbsp;derecho &nbsp;de aquella pudo &nbsp;consolidarse &nbsp;con &nbsp;anterioridad &nbsp;a &nbsp;la &nbsp;demanda &nbsp;de pertenencia, su admisi\u00f3n o, &nbsp;inclusive, &nbsp;la &nbsp;sentencia &nbsp;que &nbsp;la &nbsp;reconozca. &nbsp;De &nbsp;no ser as\u00ed, es decir, si la &nbsp;susodicha &nbsp;cesi\u00f3n &nbsp;resultare posterior a la usucapi\u00f3n que alega el demandante, &nbsp;las &nbsp;sedicentes cedentes se estar\u00edan comprometiendo a transferir un derecho que &nbsp;ya no les pertenecer\u00eda. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;3. Sin embargo, esa omisi\u00f3n del &nbsp;Tribunal, &nbsp;que &nbsp;la &nbsp;censura &nbsp;denuncia en el cargo primero de la demanda y por la &nbsp;cual &nbsp;aqu\u00e9l &nbsp;dej\u00f3 &nbsp;de &nbsp;ver las pruebas que el recurrente se\u00f1ala en el segundo &nbsp;cargo, &nbsp; es, &nbsp; francamente, &nbsp; intrascendente &nbsp; por &nbsp; las &nbsp;razones &nbsp;que &nbsp;pasan &nbsp;a &nbsp;exponerse. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;3.1 &nbsp;El art\u00edculo 674 del C\u00f3digo Civil, luego &nbsp;de &nbsp;precisar &nbsp;que los bienes de la Uni\u00f3n &nbsp; son &nbsp;las &nbsp;cosas &nbsp;cuyo &nbsp;dominio &nbsp;corresponde &nbsp;a &nbsp;la &nbsp;Rep\u00fablica, &nbsp;distingue &nbsp;entre &nbsp;aquellos &nbsp;cuyo &nbsp;\u00ab&#8230;uso pertenece a todos los habitantes de un &nbsp;territorio, &nbsp;como &nbsp;el &nbsp;de &nbsp;calles, &nbsp;plazas, &nbsp;puentes &nbsp;y &nbsp;caminos\u00bb y a los cuales &nbsp;denomina &nbsp;\u00abbienes &nbsp;de &nbsp;la &nbsp;Uni\u00f3n &nbsp;de uso p\u00fablico o &nbsp;bienes &nbsp;p\u00fablicos &nbsp;del &nbsp;territorio\u00bb, de estos otros, &nbsp;tambi\u00e9n &nbsp; de &nbsp; la &nbsp; Uni\u00f3n, &nbsp; \u201ccuyo &nbsp;uso &nbsp;no &nbsp;pertenece &nbsp;generalmente &nbsp;a &nbsp;los &nbsp;habitantes&#8230;\u00bb, &nbsp;a &nbsp;los que llama simplemente \u00abbienes &nbsp;de la uni\u00f3n o bienes fiscales\u00bb. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;De &nbsp;la &nbsp;simple lectura del aludido precepto se &nbsp;infiere &nbsp;que, &nbsp;seg\u00fan &nbsp;el C\u00f3digo Civil, los bienes de la \u00abUni\u00f3n\u00bb se clasifican &nbsp;en &nbsp;dos: &nbsp;De &nbsp;un &nbsp;lado, &nbsp;los de uso p\u00fablico, como las calles, plazas, puentes y &nbsp;caminos, &nbsp;y, &nbsp;de otro, los fiscales, es decir, aquellos que no estando adscritos &nbsp;a &nbsp;la &nbsp;prestaci\u00f3n de un servicio p\u00fablico, forman parte del patrimonio estatal, &nbsp;ya &nbsp;sea &nbsp;por &nbsp;disposici\u00f3n &nbsp;constitucional, &nbsp;o porque han sido adquiridos por la &nbsp;Naci\u00f3n, &nbsp;los &nbsp;departamentos, &nbsp;los &nbsp;municipios &nbsp;y, &nbsp;en &nbsp;general las entidades de &nbsp;derecho &nbsp;p\u00fablico, &nbsp;para &nbsp;destinarlos a la organizaci\u00f3n de los fines que le son &nbsp;propios, &nbsp;siendo &nbsp;su &nbsp;uso com\u00fan restringido o reprimido, distinci\u00f3n \u00e9sta que, &nbsp;como &nbsp; &nbsp;es &nbsp; &nbsp;sabido, &nbsp; se &nbsp; funda &nbsp; en &nbsp; conceptos &nbsp; de &nbsp; un &nbsp; n\u00edtido &nbsp; perfil &nbsp;romanista. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;En cuanto a los primeros, los de uso p\u00fablico, &nbsp;d\u00e9bese &nbsp;precisar &nbsp;aqu\u00ed que se caracterizan, como su nombre lo anuncia, porque, &nbsp;como &nbsp;acontece &nbsp;con &nbsp;algunos &nbsp;de &nbsp;propiedad &nbsp;privada, &nbsp;est\u00e1n &nbsp;destinados al uso &nbsp;com\u00fan; &nbsp;porque &nbsp;son &nbsp;inalienables &nbsp;e &nbsp;imprescriptibles &nbsp;y, &nbsp;finalmente, &nbsp;porque &nbsp;pertenecen, &nbsp;salvo &nbsp;los &nbsp;privados &nbsp;afectados &nbsp;al &nbsp;uso &nbsp;p\u00fablico, &nbsp;a entidades de &nbsp;derecho &nbsp;p\u00fablico, &nbsp;exigencia &nbsp;esta &nbsp;\u00faltima &nbsp;entendida &nbsp;en el sentido de que se &nbsp;encuentran &nbsp;sometidos &nbsp;a &nbsp;una &nbsp;singular, &nbsp;pero &nbsp;innegable, &nbsp;potestad estatal que &nbsp;excluye &nbsp;la &nbsp;propiedad privada sobre ellos, ya sea porque, como piensan algunos, &nbsp;tal &nbsp;poder configura un \u201cdominio eminente\u201d, traducido en meras facultades de &nbsp;polic\u00eda &nbsp;administrativa &nbsp;que &nbsp;apenas le conceden a su titular las facultades de &nbsp;guarda &nbsp;y &nbsp;vigilancia, sin estructurar, en todo caso, un derecho de propiedad en &nbsp;sentido &nbsp;estricto, o ya, como piensan otros, como un genuino derecho p\u00fablico de &nbsp;propiedad &nbsp;cuyo &nbsp;ejercicio &nbsp;puede &nbsp;diferir &nbsp;en varios aspectos del modo como los &nbsp;particulares &nbsp;despliegan su poder sobre los bienes, pero sin ser sustancialmente &nbsp;distintos. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Por &nbsp;el contrario, en relaci\u00f3n con los bienes &nbsp;fiscales, &nbsp;los &nbsp;entes &nbsp;de &nbsp;derecho &nbsp;p\u00fablico &nbsp;se &nbsp;comportan, en un todo, como lo &nbsp;har\u00eda &nbsp;un particular, raz\u00f3n por la cual confluyen en ellos los atributos de la &nbsp;propiedad &nbsp;que &nbsp;permite &nbsp;gravarlos, &nbsp;enajenarlos, &nbsp;arrendarlos, etc. Ahora bien, &nbsp;dentro &nbsp;de &nbsp;las caracter\u00edsticas propias de su especie, se destacaba aquella que &nbsp;los &nbsp;hac\u00eda &nbsp;susceptibles &nbsp;de ser adquiridos por usucapi\u00f3n, peculiaridad que se &nbsp;infer\u00eda &nbsp;por &nbsp;exclusi\u00f3n,&nbsp; &nbsp;de &nbsp;lo &nbsp;dispuesto &nbsp;por &nbsp;el &nbsp;art\u00edculo 2519 del &nbsp;C\u00f3digo &nbsp;Civil, &nbsp;que &nbsp;de &nbsp;manera &nbsp;contundente &nbsp;determina &nbsp;que &nbsp;los bienes de uso &nbsp;p\u00fablico &nbsp;de la Naci\u00f3n no pueden adquirirse por prescripci\u00f3n. Sin embargo, con &nbsp;la &nbsp;entrada en vigencia del C\u00f3digo de Procedimiento Civil de 1971 (decreto 1400 &nbsp;de &nbsp;1970), &nbsp;cuyo &nbsp;art\u00edculo &nbsp;413 consagr\u00f3 que \u00bb no procede la pertenencia&#8230;.ni &nbsp;respecto &nbsp;de &nbsp;bienes imprescriptibles o de propiedad de las entidades de derecho &nbsp;p\u00fablico\u00bb, &nbsp;desapareci\u00f3 &nbsp;una &nbsp;de &nbsp;las particularidades que permit\u00eda, junto con &nbsp;las &nbsp;ya &nbsp;apuntadas, &nbsp;diferenciar &nbsp;los &nbsp;bienes &nbsp;fiscales &nbsp;de los de uso p\u00fablico, &nbsp;habida &nbsp;cuenta &nbsp;que &nbsp;frente &nbsp;a &nbsp;unos y otros se torna improcedente la acci\u00f3n de &nbsp;pertenencia.&nbsp; &nbsp;Pero, hay que decirlo tambi\u00e9n, no por ello puede concluirse &nbsp;que &nbsp;en &nbsp;la &nbsp;actualidad &nbsp;se &nbsp;unificaron tales conceptos, o que la clasificaci\u00f3n &nbsp;hubiese &nbsp;dejado &nbsp;de &nbsp;existir, &nbsp;o &nbsp;que &nbsp;los &nbsp;bienes fiscales pasaron a ser de uso &nbsp;p\u00fablico. &nbsp;Aconteci\u00f3, &nbsp;simplemente, &nbsp;que lo que otrora fue uno de los criterios &nbsp;de &nbsp;diferenciaci\u00f3n hoy dej\u00f3 de serlo, sin que por tal raz\u00f3n la disimilitud se &nbsp;haya esfumado. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;3.2. &nbsp;Si bien ya se ha dicho que dentro de las &nbsp;particularidades &nbsp;que &nbsp;distinguen &nbsp;los &nbsp;bienes &nbsp;de &nbsp;la Uni\u00f3n de uso p\u00fablico se &nbsp;encuentra &nbsp;la &nbsp;consistente &nbsp;en &nbsp;que &nbsp;la &nbsp;titularidad &nbsp;de &nbsp;los mismos corresponde &nbsp;siempre &nbsp;a una entidad de derecho p\u00fablico, nada impide, empero, que por razones &nbsp;de &nbsp;diversa &nbsp;\u00edndole &nbsp;los &nbsp;particulares puedan destinar al uso com\u00fan bienes que &nbsp;les &nbsp;pertenezcan &nbsp;o construir en ellos v\u00edas, parques o edificaciones destinadas &nbsp;a &nbsp;tal &nbsp;fin, &nbsp;caso &nbsp;en el cual, por mandato del art\u00edculo 676 del C\u00f3digo Civil, &nbsp;\u201clos &nbsp;puentes &nbsp;y &nbsp;caminos &nbsp;construidos a expensas de personas particulares, en &nbsp;tierras &nbsp;que &nbsp;les &nbsp;pertenecen, &nbsp;no &nbsp;son bienes de la &nbsp;Uni\u00f3n, &nbsp;aunque los due\u00f1os permitan su uso y goce a &nbsp;todos &nbsp;los &nbsp;habitantes &nbsp;de &nbsp;un territorio&#8230; Lo mismo se extiende a cualesquiera &nbsp;otras &nbsp;construcciones &nbsp;hechas &nbsp;a &nbsp;expensas &nbsp;de particulares, en sus tierras, aun &nbsp;cuando su uso sea p\u00fablico, por permiso del due\u00f1o\u201d (se subraya). &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;Significa &nbsp;lo &nbsp;anterior, &nbsp;entonces, &nbsp;que &nbsp;aun &nbsp;cuando, &nbsp;en sentido &nbsp;estricto, &nbsp;los &nbsp;bienes &nbsp;de &nbsp;uso p\u00fablico se caracterizan porque pertenecen a una &nbsp;entidad &nbsp;de &nbsp;derecho &nbsp;p\u00fablico que los asigna al uso com\u00fan, nada se opone a que &nbsp;los &nbsp;particulares destinen, tambi\u00e9n, al uso general, bienes que les pertenecen, &nbsp;o &nbsp;que &nbsp;construyan &nbsp;en ellos obras enderezadas a tal finalidad, todo ello, claro &nbsp;est\u00e1, &nbsp;sin &nbsp;menoscabo &nbsp;de su derecho de dominio o de la posesi\u00f3n que sobre los &nbsp;mismos &nbsp;ejercen, &nbsp;y &nbsp;sin que, obviamente, ese acto de desprendimiento constituya &nbsp;venero &nbsp;que &nbsp;permita &nbsp;consolidar &nbsp;alg\u00fan &nbsp;derecho &nbsp;para &nbsp;quienes &nbsp;se &nbsp;sirven &nbsp;de &nbsp;ellos. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;\u201cLuego, &nbsp;ha &nbsp;dicho &nbsp;la &nbsp;Corte, los puentes y &nbsp;caminos &nbsp; as\u00ed &nbsp;como &nbsp;las &nbsp;dem\u00e1s &nbsp;obras, &nbsp;(calzadas, &nbsp;canales, &nbsp;etc.), &nbsp;que &nbsp;se &nbsp;construyan &nbsp;por &nbsp;los &nbsp;particulares &nbsp;a &nbsp;sus &nbsp;expensas &nbsp;y &nbsp;en&nbsp; terrenos de su &nbsp;propiedad, &nbsp;no &nbsp;pasan &nbsp;al &nbsp;dominio &nbsp;de &nbsp;la &nbsp;Naci\u00f3n por el solo hecho de que sus &nbsp;due\u00f1os &nbsp; permitan &nbsp;que &nbsp;los &nbsp;habitantes &nbsp;de &nbsp;un &nbsp;territorio &nbsp;puedan &nbsp;libremente &nbsp;transitar, &nbsp;pasear, &nbsp;estacionarse o reunirse en esos sitios. Son \u00e9stos actos de &nbsp;mera &nbsp;facultad &nbsp;que &nbsp;de &nbsp;acuerdo &nbsp;con &nbsp;el &nbsp;art\u00edculo 2520 del C.C., no confieren &nbsp;posesi\u00f3n ni dan lugar a prescripci\u00f3n alguna. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;\u201cPor &nbsp; tanto, &nbsp; la &nbsp; sola &nbsp; destinaci\u00f3n &nbsp;o &nbsp;afectaci\u00f3n &nbsp;de &nbsp;un &nbsp;inmueble de propiedad particular a servicio p\u00fablico, no es &nbsp;ni &nbsp;puede &nbsp;ser &nbsp;t\u00edtulo &nbsp;suficiente &nbsp;en &nbsp;favor de la Naci\u00f3n y menos a\u00fan de los &nbsp;particulares, &nbsp;que &nbsp;al &nbsp;gozar y usar de tal servicio no ejercitan acto alguno de &nbsp;posesi\u00f3n material. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;\u201cDicho &nbsp;en &nbsp;otros &nbsp;t\u00e9rminos, lo que da a un &nbsp;bien &nbsp;el &nbsp;car\u00e1cter &nbsp;de bien de la Uni\u00f3n de uso p\u00fablico o de bien p\u00fablico del &nbsp;territorio &nbsp;-para &nbsp;emplear &nbsp;una &nbsp;cualquiera de las expresiones de que se vale el &nbsp;inciso &nbsp;2\u00ba &nbsp;del &nbsp;art. &nbsp;674 del mismo C.C.-, no es solamente su afectaci\u00f3n a un &nbsp;servicio &nbsp;p\u00fablico. &nbsp;Es &nbsp;necesario, adem\u00e1s, que esa afectaci\u00f3n o destinaci\u00f3n, &nbsp;decretada &nbsp;por &nbsp;la &nbsp;autoridad, &nbsp;est\u00e9 respaldada por un t\u00edtulo de dominio sobre &nbsp;tal &nbsp;bien &nbsp;y &nbsp;a &nbsp;favor &nbsp;de &nbsp;la Naci\u00f3n misma. Lo contrario constituir\u00eda el m\u00e1s &nbsp;franco &nbsp;y &nbsp;absoluto &nbsp;desconocimiento &nbsp;del &nbsp;derecho &nbsp;de propiedad\u201d (G.J. LXXIV, &nbsp;p\u00e1g. 797). &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;D\u00e9bese &nbsp;destacar, &nbsp;entonces, &nbsp;y &nbsp;con especial &nbsp;reciedumbre, &nbsp;que &nbsp;de &nbsp;la cabal interpretaci\u00f3n de los art\u00edculos 676 y 2520 del &nbsp;C\u00f3digo &nbsp;Civil, &nbsp;se &nbsp;colige &nbsp;que &nbsp;quienes &nbsp;usan &nbsp;un &nbsp;bien &nbsp;sometido al se\u00f1or\u00edo &nbsp;privado, &nbsp;pero &nbsp;puesto &nbsp;de &nbsp;manera &nbsp;inequ\u00edvoca &nbsp;y &nbsp;real &nbsp;por &nbsp;su propietario al &nbsp;servicio &nbsp; com\u00fan, &nbsp; como &nbsp;aqu\u00ed &nbsp;acontece, &nbsp;no &nbsp;llegan &nbsp;a &nbsp;consolidar &nbsp;derechos &nbsp;particulares &nbsp;de &nbsp;ninguna &nbsp;especie, &nbsp;derivados &nbsp;de &nbsp;su &nbsp;mera utilizaci\u00f3n, ello, &nbsp;inclusive, &nbsp;en &nbsp;el &nbsp;supuesto de que ejercitaren actos de dominio sobre el mismo, &nbsp;pues &nbsp;en &nbsp;tal caso, esa posesi\u00f3n devendr\u00eda, por lo in\u00fatil, en ineficaz; tales &nbsp;bienes, &nbsp;en &nbsp;s\u00edntesis, son imprescriptibles mientras se encuentren afectados al &nbsp;uso &nbsp;com\u00fan &nbsp;al &nbsp;cual los destin\u00f3 efectivamente su due\u00f1o. No es posible, desde &nbsp;luego, &nbsp;que &nbsp;el &nbsp;derecho &nbsp;de &nbsp;dominio &nbsp;de quien se desprende del aprovechamiento &nbsp;particular &nbsp;de &nbsp;un &nbsp;bien, &nbsp;movido &nbsp;por criterios de utilidad social y, por ende, &nbsp;encaminado &nbsp;a &nbsp;satisfacer &nbsp;intereses &nbsp;generales, &nbsp;sufra &nbsp;mengua por los actos de &nbsp;terceros &nbsp;que pretendan consolidar derechos originados en el uso tolerado por el &nbsp;propietario, &nbsp;pues &nbsp;de &nbsp;ser &nbsp;ello &nbsp;posible, &nbsp;se quebrantar\u00edan los principios de &nbsp;prevalencia &nbsp;del &nbsp;inter\u00e9s &nbsp;general &nbsp;y de la funci\u00f3n social de la propiedad que &nbsp;irradia la Constituci\u00f3n Pol\u00edtica Colombiana. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; 3.3. &nbsp; Obra &nbsp;al &nbsp;folio &nbsp;194 &nbsp;del &nbsp;cuaderno &nbsp;principal, &nbsp; copia &nbsp;del &nbsp;escrito &nbsp;mediante &nbsp;el &nbsp;cual &nbsp;la &nbsp;sociedad &nbsp;constructora &nbsp;\u201cUrbanizaci\u00f3n &nbsp; Muz\u00fa &nbsp;S.A\u201d, &nbsp;de &nbsp;cuyos &nbsp;derechos &nbsp;son &nbsp;causahabientes &nbsp;las &nbsp;sociedades &nbsp;demandadas, &nbsp;por &nbsp;haberles recibido en el proceso de liquidaci\u00f3n de &nbsp;aquella &nbsp;(escritura &nbsp;227 &nbsp;del 22 de diciembre de 1970, folio 53 del cuaderno 1), &nbsp;solicit\u00f3 &nbsp;al &nbsp;Director &nbsp;de &nbsp;la &nbsp;Oficina &nbsp;de &nbsp;Planeaci\u00f3n Distrital que aceptase &nbsp;canjear &nbsp;los &nbsp;lotes &nbsp;que &nbsp;inicialmente se hab\u00edan destinado a \u201czonas verdes\u201d &nbsp;por &nbsp;otros que resalt\u00f3 en el plano B4\/2-4, que igualmente obra en el expediente &nbsp;(folio &nbsp;161 &nbsp;del cuaderno Principal; folio 21 del cuaderno 3), uno de los cuales &nbsp;es &nbsp;objeto &nbsp;de &nbsp;este &nbsp;litigio. &nbsp;Canje que, como aparece en el aludido plano, fue &nbsp;aceptado &nbsp;por &nbsp;el &nbsp;Distrito, &nbsp;aceptaci\u00f3n que, por lo dem\u00e1s, tambi\u00e9n se colige &nbsp;del &nbsp; oficio &nbsp; D.J. &nbsp;340\/309\/89, &nbsp;emanado &nbsp;del &nbsp;Departamento &nbsp;Administrativo &nbsp;de &nbsp;Planeaci\u00f3n &nbsp;Distrital &nbsp;(folio &nbsp;156 &nbsp;del &nbsp;cuaderno &nbsp;1), &nbsp;en &nbsp;el &nbsp;que &nbsp;se lee que &nbsp;\u201c&#8230; &nbsp;\u2018En &nbsp;relaci\u00f3n &nbsp;con &nbsp;la zona de reserva denominada \u201cA\u201d definido &nbsp;en &nbsp;el &nbsp;Plano &nbsp;de &nbsp;Urbanizaci\u00f3n &nbsp;B-4\/ &nbsp;2 &nbsp;&#8211; &nbsp;4 &nbsp;zona &nbsp;integrada &nbsp;con &nbsp;las &nbsp;Manzanas&nbsp; &nbsp;76 &nbsp;y &nbsp;78&nbsp; &nbsp;(subrayamos) &nbsp;del &nbsp;primer &nbsp;sector &nbsp;y &nbsp;que en parte de dicho terreno funciona una &nbsp;escuela, &nbsp; se &nbsp;puede &nbsp;observar &nbsp;que &nbsp;el &nbsp;resto &nbsp;del &nbsp;predio &nbsp;est\u00e1 &nbsp;involucrado en la zona de reserva &nbsp;como &nbsp;canje &nbsp;de &nbsp;las &nbsp;zonas &nbsp;verdes &nbsp;y &nbsp;los &nbsp;destinados a &nbsp;parqueo&nbsp; &nbsp;(subrayamos) &nbsp;Manzana &nbsp;A &nbsp;y &nbsp;B seg\u00fan &nbsp;plano &nbsp;B &nbsp;&#8211; &nbsp;14\/ &nbsp;1 &nbsp;del segundo sector que fueron loteados por el urbanizador y &nbsp;referenciado &nbsp;en &nbsp;el &nbsp;Plano No. 3792 de Mayo 29 de 1961 y confirmado en el Plano &nbsp;de &nbsp; Canje &nbsp; de &nbsp; Zonas &nbsp;(subrayamos) &nbsp;con &nbsp;la &nbsp;misma referencia y la misma fecha aceptado y aprobado por &nbsp;el &nbsp;Departamento &nbsp;Administrativo &nbsp;de Planeaci\u00f3n Distrital&#8230; En consecuencia de &nbsp;lo &nbsp;anterior &nbsp;se &nbsp;considera &nbsp;que ustedes est\u00e1n en mora de elevar a instrumentos &nbsp;p\u00fablicos &nbsp; &nbsp; &nbsp; el &nbsp; &nbsp; &nbsp; respectivo &nbsp; &nbsp; &nbsp; canje &nbsp; &nbsp; &nbsp; de &nbsp; &nbsp; &nbsp; zonas\u2019&#8230; &nbsp; &nbsp;Encontramos &nbsp; &nbsp;en &nbsp; &nbsp;este &nbsp;pronunciamiento &nbsp;de &nbsp;la &nbsp;Procuradur\u00eda &nbsp;en &nbsp;1979 &nbsp;concordancia con el Oficio No. &nbsp;00335 &nbsp;del &nbsp;8 &nbsp;de &nbsp;marzo &nbsp;de 1968 expedido por el Departamento Administrativo de &nbsp;Planeaci\u00f3n &nbsp;Distrital, &nbsp;dirigido &nbsp;al &nbsp;se\u00f1or &nbsp;ARTURO &nbsp;ZULUAGA MACHADO, Sociedad &nbsp;Urbanizadora &nbsp; &nbsp;Muz\u00fa, &nbsp; el &nbsp; cual &nbsp; precept\u00faa &nbsp; lo &nbsp; siguiente: &nbsp; \u2018\u2026que de acuerdo con los planes de &nbsp;canje &nbsp;aprobados &nbsp;mediante &nbsp;Oficio &nbsp;No. &nbsp;4958 &nbsp;de &nbsp;Mayo 30 de 1991 en base a una &nbsp;solicitud &nbsp;hecha &nbsp;por &nbsp;usted, la Manzana 75\/76 y zona &nbsp;de &nbsp;reserva &nbsp;del &nbsp;Plano &nbsp;B-4\/4 de la Urbanizaci\u00f3n La Laguna est\u00e1n destinados a &nbsp;zona &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; escolar &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; y &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;parque &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;(subrayamos)&#8230;\u201d.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;Es &nbsp; palpable, &nbsp; entonces, &nbsp; que &nbsp;la &nbsp;aludida &nbsp;sociedad, &nbsp;para dar cumplimiento a los reglamentos que a la saz\u00f3n gobernaban la &nbsp;actividad &nbsp;urbanizadora en la ciudad capital, afect\u00f3 unos lotes de su propiedad &nbsp;al &nbsp;uso &nbsp;p\u00fablico, &nbsp;particularmente &nbsp;al &nbsp;servicio &nbsp;de &nbsp;los habitantes del lugar, &nbsp;motivo &nbsp;por &nbsp;el &nbsp;cual, ning\u00fan miembro de la comunidad, como tampoco la Junta de &nbsp;Acci\u00f3n &nbsp;Comunal &nbsp;del sector, aqu\u00ed demandante, pod\u00eda ejercitar posesi\u00f3n sobre &nbsp;ellos al abrigo de la tolerancia de sus due\u00f1os. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;En &nbsp;ese orden de ideas, los supuestos actos de &nbsp;se\u00f1or\u00edo &nbsp;alegados &nbsp;por &nbsp;la &nbsp;actora &nbsp;en la demanda, y cuya ambig\u00fcedad, en todo &nbsp;caso, &nbsp;pusieron &nbsp;de &nbsp;manifiesto &nbsp;los &nbsp;testigos &nbsp;escuchados &nbsp;en &nbsp;el &nbsp;proceso, &nbsp;no &nbsp;consolidan &nbsp;posesi\u00f3n \u00fatil en su favor que le permita reclamar la prescripci\u00f3n &nbsp;adquisitiva del mismo. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp;&nbsp; &nbsp;Subsecuentemente, los cargos no prosperan. &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;D E C I S I O N: &nbsp;&nbsp;<\/p>\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp;&nbsp; &nbsp; &nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;La &nbsp; Corte &nbsp; Suprema &nbsp;de &nbsp;Justicia, &nbsp;Sala &nbsp;de &nbsp;Casaci\u00f3n &nbsp;Civil &nbsp;y agraria, administrando justicia en nombre de la Rep\u00fablica y &nbsp;por &nbsp; autoridad &nbsp; de &nbsp;la &nbsp;ley, &nbsp;NO &nbsp;CASA &nbsp;la &nbsp;sentencia &nbsp;proferida por la Sala Civil del Tribunal Superior &nbsp;del &nbsp;Distrito &nbsp;Judicial &nbsp;de Santaf\u00e9 de Bogot\u00e1, dentro del proceso ordinario de &nbsp;pertenencia &nbsp;
